question about i134..will i include my kids on my i134 even if i dont have the custody of them..it said on line 8 and 10 on i134 asking have you ever support someone before..will i put my ex wife and my kids?please help on question 8, 9 and 10,will they count it as people on my home?

Claim people in your home that live there full time or where you are the primary residence for children from a past relationship and/or if you claim them as dependents on your taxes.

Household Size - The number of people in a sponsor's household is used in calculating the minimum sufficient income based on the poverty guidelines, to ensure that a family will have enough income to support their existing household as well as an intending immigrant. Household size includes: the sponsor; all relatives by blood, marriage or adoption residing in the sponsor's household; all dependents listed on the most recent tax return, whether or not they reside in the sponsor's household; any individuals for whom the sponsor has previously signed an I-864 and for whom the contractual obligation still exists; the beneficiary (principal applicant/intending immigrant); this beneficiary's accompanying dependents.

So NO to your ex-wife unless she still resides with you and is listed as a dependent on your tax return. If she is still listed as a dependant on your tax return, why is this and of course your next return she would not be on it. I guess there are cases where an ex-wife is still a dependent and then she would be listed. YES to your kids if they are listed on your tax return as dependents. You must list your fiance who will be a dependent and then add yourself.

They will use a formula based on the poverty guidelines to see if you are overburdened by supporting people.

Timeline

Yes, include them in your household size since, as the above poster stated, you claim them as dependents on your taxes. Regardless if they actually live with you, you are a source of financial support for them. So your household includes you, your fiance, and your kids.

yes i do have child support and i include them on my taxes

Then the children count. Your ex-wife does not count UNLESS she was a foriegn immigrant which you signed an I-864 for and you are still obligated to under the I-864
