10 year visa vs 2 year visa

How is it determined if the Visa that is granted is a 10 year visa or a 2 year visa?

My husband received his CR-1 Visa today in the mail but after reading the cover letter it it sounds like if he waits to enter the POE until after our 2nd weeding anniversary he will receive a 10 year visa rather than a 2 year visa.

Is that true? Just 2 months from now we will celebrate 2 years of being married and if we can get a 10 year visa than I think we should wait until 2 months from now for him to come to the States.

Does anyone have any suggestions? It has been so much work just to get his Visa but if I read correctly he has 6 months to enter the U.S.A from the time of the Visa and if he waits just 2 more months we can have the 10 year visa but I do not want to jeopardize all of the work we have done so far...

Yes it is 10 year or two year conditional green card.I think it doesnt depends on when u enter US.It depends on if u received ur CR1 visa before u were married for 2 years,which he have got already.But again i m not sure.

Mar 4,09 NVC recvd fee

Mar 10,09 AOS sent

Mar 30,09 mailed DS-230

Apr 13,09 CASE COMPLETED(per operators)

Apr 20,09 FINAL REVIEW

Apr 21,09 CASE COMPLETED (per AVR)

Apr 23,09 called:INTERVIEW JUNE 24th

Jun 24,09 AP, 1-3 months

Calling DOS begins,here is what I was told

Jul 7,09 No info @ DOS

Jul 10,09 Case sent to DC-pending

Jul 17,09 Pending

Jul 24,09 Pending,you can call every day for update but the day they call him for passport it means something is up so you get to know it before we do

Jul 31,09 Pending AP

Aug 06,09 Call from USEM requesting to submit passport

Aug 07,09 Every thing looks very good,visa issuance is up to the consulate!!!

Aug 07,09 Passport submitted

Aug 07,09 USEM is requesting applicant's passport :)

Aug 17,09-call 1 Visa issued Aug 3rd,EM recvd passport on 10th but still havent returned it

Aug 17,09-call 2 Case pending some kind of processing (URGHHHHHHHHH NOT AGAIN)

Aug 18,09 call to pick up passport,picked up from AMEX

Sep 26,09 REUNION :)

Yeah if he enters after 2nd wedding anniversary he will recive 10 YEARS GREEN CARD if he enters before 2nd wedding anniversary he will recive 2 YEARS GREEN CARD and you will have to file REMOVING OF CONDITIONS before 90 days of 2nd wedding anniversary then he will get 10 YEARS GREEN CARD.

If I were in your shoes, I' wait until your second anniversary, unless there are compelling reason to do otherwise. Preparing packages for the USCIS gets old after a while, not to mention expensive.

If we's have had the option of getting the 10 year GC instead of a 2 year we's have gone for it. Saves the cost [$545] and hassel of removing conditions.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!
