But when I read the directions i states, just submit 1 year... notice, there is no S after the YEAR~

So, we attach 1 copy of our copy of the federal income tax return for 2008?

The next papargraph of the instructions is the potential issue: If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support.

So if you send the last 3 year's transcripts / returns that ought to eliminate any questions and possible RFE for tax returns.

FWIW, I sent the 3 years as suggested.

If you just read the WHOLE paragraph dealing with tax submissions it says:

25. Federal Income Tax Information.

You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

No need to look for Issues, 5 paragraphs later dealing with someone who was not required to file really has NOTHING to do with the original OP question.

Just submit the last year unless the previous years returns will make your case look better...so example. Last year you only made 25k due to down economy previous years you made 35k+ per year this would look good due to showing your ability to make better money just had a bad year.

I am by no means saying you should not send in three years if it will help your case, but someone who made $1500. in 2006 , $12,000. in 2007 and $21,000 in 2008 is not gonna benefit from your advice IMHO.

Also using a paragraph in the instructions that deals with someone who DID NOT file and what they need to do has nothing to do with the OPS question, didn't mean to step on your toes regardless of how many time you have traversed the AOS gauntlet.

Besides I did agree with the three returns by my quote "Just submit the last year unless the previous years returns will make your case look better" in case you missed it.
