Ok here it is I am legally married to a uk man I am from the Us .I thought it would be easy and we would get a visa easy since I was pregnet and we got married and was crazy in love

.Well our son is born and hes over stayed his visa by 7 months .I have 3 other kids who love him to death on top of seeing a councler due to there issue they had with my ex there father .

Now on top of my son was born early 36 weeks because I got really sick and the 3 other kids and my baby has health issues i have proof of all of this

I could loose my husbend .I am very new to all of this sounds dumb but I thought we would be ok even went to talk to a immigration officer when i was still pregnet .

Well now I geuss even though we are trying to save up for the money for the paper work since i am the only one that can bring income

we still might get in trouble could someone give me info he was on a visa waiver im really scared looseing him and raiseing 4 kids alone until i see him .I know i should have thought about that but i really didnt think it was this hard please help .

Sorry, I just noticed your post waiting for approval in the Immigration News forum so moved it here where it is more appropriate.

If your husband entered the US legally and you did not have the intentions of getting married when he arrived, he can apply to adjust his status to a permanent resident from within the US. He would submit an I-485 application form and you would include an Affidavit of Support form. You need to be able to show that you can afford to support him and the rest of your family at 125% of the poverty level, so if you are finding things financially tough, you may need to find someone who does meet the income requirements to co-sponsor him. If you're finding the process very difficult and confusing then you may want to consider a least a consultation with an immigration attorney to get you started. Better to do that than try to muddle through and get things wrong. That's where you will run into trouble.
