Timeline

Hi Everyone,

My fiancee will be coming here to the USA probably around February of next year but will need to travel back to the Philippines around December. My question is how long can she stay in the Philippines before she must return. I am unclear of how long an AP is good for. Thanks.

Moved from K-1 process to Travel prior to GC

AP is usually good for one year.

However, I would not recommend staying more than 6 months - interview for the AOS comes to mind. (Bio appointments, etc..)

(unless she can travel readily)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Did you have an idea how long she would want to be there? (Very likely she would have her PR/Green Card by that time so it would come down to maintaining her permanent residency status.)

Thank you for the quick reply. She will only need to be there for three or four months.

90/120 Days would not be an issue.

The AP you get with a K1 AOS is VALID for one year, for multiple entires, but absences should not be more than 180 days without a specific AP for that trip. We are told, and will soon find out for sure as our son will return to Russia for education, that if the person is a foreign student, they can be out of the country for not more than 365 days. We may just get an AP to be sure.

3-4 months is not a problem. (unless it interferes with an AOS interview or something)
