The spelling issue can be a difficult hurdle depending on the changes being made, especially in Ukraine. My wife had provided me with her old passport based upon Russian. But, since it was due to expire within a year, she obtained a new passport based upon Ukrainian. Several letters in her name change with y's changing to i' and E becoming O in her first name. We changed the paperwork to accomodate the new spelling, but we had just started it and hadn't filed anything.

Considering how many different ways there are to spell the same name, every embassy and the USCIS should be a little more casual with the spelling.

The consulates ARE pretty casual about it, I cannot say I am sure the USCIS is. Maybe. We usually recommend you use the name exactly as in her passport (Ukrainian passports are in both Ukrainian and transliterated English). Even though often it is not the spelling they prefer. Let anyone doing translations know this.

That's interesting, because a colleague of mine who had his "Russian" spelling passport

also had to have it changed to the Ukrainian transliteration by the state department.

That included all his work ID documents and everything else.

What a headache, even for someone who had been working in NY for more than 20 years.
