No tax returns.

Hello,

My fiance is filling out the Affidavit of Support. Unfortunately, he can't find/doesn't have his tax returns from last year. This is what the consulate states in their website regarding the Affidavit:

18. AFFIDAVIT OF SUPPORT

? Form I-134,

? Last federal income tax,

? Proof of citizenship or green card

I e-mailed them asking if bank statements or a bank letter and an Army employment letter (showing his earnings) would suffice instead of tax returns, and their answer was "check our website". <_<

So, since they aren't going to tell me, do you guys know if we will be ok or not? Thanks!

K-1 TIMELINE:

05-11-2009: NOA1

05-20-2009: called the Military Help Line and requested for expedite

06-04-2009: NOA2

06-14-2009: NVC letter received in the mail

07-02-2009: Packet 4 received

08-27-2009: Interview - Visa approved!

09-03-2009: visa in hands.

09-20-2009: POE - Miami

09-21-2009: we got married!

AOS TIMELINE:

05-12-2010: NOA1

06-08-2010: Case transferred to CSC

06-21-2010: Biometrics

The answer is there as you've posted: it is required. Not submitting it will result in an RFE and add time to your journey.

Also, he will need his tax return(s) again when you adjust status after marrying. So better to be prepared.

He can obtain a transcript of his return from the IRS at no charge. See this page on the IRS website for the phone number to call. http://www.irs.gov/individuals/article/0,,id=110571,00.html

You can tell him that he can call the IRS and they will send all tax info for whatever years you may need. I called them the other day it took about 5 minutes to request and it was mailed to me with in 6 days.

If he has fax machine closed to him, he can ask IRS to fax it.

But resolution is not good.

Usually if you ask for Tax Return Transcript for last 3 years, you can get it within 3~4 weeks.

He went ahead and got his tax returns from TurboTax, it's easy and we can just print it out from the internet. We are stils waiting on IRS to mail us what we required. If we don't ever get that until the interview, will the TurboTax one suffice? Thanks!

Turbo tax forms (signed) will work fine as long as you also have the W2's/1099's to send along as well.
