Hi! I'm going to be a US Citizen soon. I wanna petition my sister and her 4-year old son. Can I include her son on the same petition or what other forms I need to fill out? How can I petition my brother-in-law also?

November 1 - Received NVC Case Number

You don't have to file any paperwork for her son or husband. File an I-130 for your sister only. When her number comes up, they can apply for visas at the same time she does. They automatically qualify.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Timeline

It will take about 23 years for your sister to get a visa, her child will be over 21 by then and will not get a visa to accompany his mother. People who have a priority date of Aug 08 1986 visa numbers are now available for them. So your sister is in for a very long wait.

The child may still be eligible for a visa if it takes USCIS over 7 years to approve the petition and CSPA still existing in its current form or something similar. In 23 years, the child would be 27 years old + x months. If USCIS took 7 years or longer to approve the petition, the child's CSPA age would be under 21 making him eligible for a visa if he is unmarried at the time. This is all premise on the law remaining the same in 23 years.
