Is this a FALSE RFE???

Hi

Well today I got the automated message saying that my documents have been reviews and the checklist had been mailed on July 9th.

I called to find out what was the problem and I was told that the AOS was accepted, and now DS-230 is reviewed and it will take like another week. She said the system has a problem and sometimes gives this message when DS-230 is not reviewed completely yet. So anybody else had this problem??? Is this a false RFE??? Should i be worried??

Please share your experience.

06/25/2009. Mailed DS-230 package form Azerbaijan received by NVC on 06/30/2009

07/09/2009. False RFE (ds-230 wasn't in the system yet)

07/14/2009. Case Completed!!!

07/30/2009. Got the interview date.

09/29/2009. Interview Passed.

09/30/2009. Visa issued.

10/25/2009. POE Atlanta, Georgia

11/07/2009. 10 year Green Card received!!!!

Yep that's a false RFE, nothing to worry about. Do pay attention to the AVR for the next week and make sure that the date they say the checklist was generated doesn't change to a more current one. That would indicate that an actual RFE has been issued.

Though I actually got 2 false RFEs so it could mean nothing at all. Just check with the operator if that does happen.

But for now you're safe!

Timeline

sometimes, in my case, i sent the AOS paperwork and paid the IV bill, but held off on sending the ds-230 for timing purposes...i got a RFE e-mail checklist and later sent the ds-230 package which kinda screwed up my AVR message....it kept on saying checklist recieved and undergoing "processing"...never really was a RFE, once the system is ready to move forward, it wants to move forward, if the proper forms are not there it will generate a checklist needed or recieved...i had a few mojito's tonight so this might not make much sense...go figure...lol...good luck

I'm at the same stage as azar. I called Friday and got a similar recording but they did lit mention a checklist. Instead the IVR said

"Your Documents have been reviewed and there was missing or incomplete information. A letter had been sent on July 9th detailing what was missing."

Phones are busy this morning but I will keep trying. Does this fit the "False RFE" profile?

Mine is not a False RFE. Called NVC operator, they are waiting on my DS230 part 2. Somewhere I got the Idea not to send in the DS230 part 2 but keep it until the interview.

so just like imaisha said I have started to watch if the date of checklist on automated system will change.

So today it did change from July 9th to July 11th. I called and the lady asked me if i mailed Ds-230 part II. I know i did, because it has been mentioned here many times to mail it but not to sign it. Then she said that nothing is needed and they are waiting on some processing here before completing the case. She didnt mention final review but just said some processing. Now I hope this is not AP because I already had a 6 months FBI name checks at USCIS making it total of 13 months for my I-130 to be approved.

Any idea?

Also I just received an email from NVC with a checklist. And it was asking for DS-230 package. Was generated on 11th not 9th. So not sure what was mailed on 9th then.

I also got the double false RFE, June 9th and June 11th. I never received the emailed checklist though- I only knew what was going on from the AVR and speaking to the operators.

If the operator confirmed that they received the IV package then you're probably safe.

6 days after I got the second false RFE my case was complete.

You might try calling again 1) to double check that they have the IV package recorded in their system and 2) to express to them that you spent 13 months at USCIS. I'd guess that you've only got a few more days, maybe a week left at NVC but I've read that they are sometimes sympathetic toward people who had a rough time with USCIS and push it through a little faster.

So what further instrauctions I need to wait for? I saw the trick about tracking DHL ackage to the embassy? When should I try that?

Also when and from where do I find my interview date?

Hooray! NVC will e-mail you an interview letter... not sure what the wait time is for your embassy though. They say they only schedule during the second week of every month but many people have gotten them at other times (I got mine the third week). You can't try the DHL trick until your appointment has been scheduled- NVC will hang on to the package until then.

The interview letter will contain a link to this site: http://travel.state.gov/visa/immigrants/info/info_3731.html so you can start reading up and make sure you're ready for the medical, etc.

What if you received an RFE a day after you actually sent the documents that NVC is asking, will you just disregard the RFE?

My situation was, I sent the DS230 packet first to the NVC, and hubby sent the AOS later than we we're expecting. So last 21st hubby sent the AOS finally and just on 22nd we received the RFE for the AOS (financial Evidence) in my email.

can we just disregard this?

Yep you can ignore that, but check in with NVC in a few days to make sure the AOS was entered into their system and processing resumed.
