got a request for initial evidence

hi

i applied for AOS last month and today I got two yellow letters in the same envelope each headed "request for initial eveidence (I-485)"

the first letter sheet says that the household member needs to submit all federal income tax returns for the most resent tax year. when i send the AOS pacakge i sent last years tax returns because he has not yet filled the most recent years. do I have to get him to file and then send the most recent years tax returns? also the second sheet says that he does not meet the poverty line, but he earns way way more, did they just say this because of the tax returns?

Timeline

Make sure you have the current poverty guidelines and that his tax returns do show that. Remember the household is everyone filed as his dependent, himself, and you. If need be, get a co-sponsor.

And yes, at this time in the year it's expected that he has the latest tax returns and they're probably expecting to see it.

Uhm...taxes were due back in April - it's almost July.

Yes - he should file the 2008 tax return - and submit all supportind documents too (i.e., W-2s, 1099, etc).
