Does anyone know for sure if unemployment insurance is considered public assistance? If possible, can you provide any links on the answer to this question?

Unemployment payments is not a means-tested benefit so it does not count.

It is not considered public assistance.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thankyou, now I can sleep tonight.

We hired a lawyer to do our K-3 paperwork, but now I want to try and save paying another $1200 fee to do our AOS paperwork. I am starting to re-think the idea of just paying him and not worrying about if it's done right or not, lol. I am so thankful for this site, and everyone on it. Wish me luck to not mess anything up!

Unemployment is NOT public assistance, it is an insurance plan paid for by employers. Also, bear in mind this form is asking questions of the immigrant, NOT the US citizen. If your spouse has never been here before the answer would necessarily be "NO". whether the US citizen ever received public assistance is not a factor in the process.
