I have a whole lots of questions to ask and i hope you guys will be kind enough to analyse and depict what points i am trying to make before you anwser my questions... Me and my spouses loves each other so much and because of been away from each other we feels bad sad and unhappy everyday on phone and during our im's and even gets crabby with each other but we both believe that was because we are away from each other and we miss been together very much, but we are always good and we have planned never to live without each other again as we plan one of us will move to settle with the other who is awaiting the visa. And to my QUESTIONS P A L S !!!!!!!!

On the USCIS website the processing times for various visa categories was tabulated and for instance the I-129 and I-130 where either stipulated or confirmed to be 5months. My question does the 5months applies to USCIS alone to recieving a case and approving or the 5months also includes the NVC services (meaning taking uscis and nvc process the case for 5months or what?). What is the date of the USCIS Fiscal Year for 2009(FY2009). Are visas number automatically available to spouse of US citizen? When your case is recieved and pending what should or can you do if it has not been touched for weeks on the USCIS website? What could be classify as a potential age difference between a US citizen and his/her spouse (the beneficiary), is there a age limitation? What is the implication of a first-in-visit marriage and a short courtship which preceeded into marriage and the possible decision of a visa interviewer in such a case? How long can a marriage couple lived together in the foreign spouse country before the interview date at a US consulate or Embassy in other to establish a evidence of bonafide relationship? Does the spouse been pregnant makes am Entry clearance official to grant a visa? Can the petitioner be present at the interview in the foreign spouse country when he/she goes for interview.

Only USCIS.

I'm pretty sure they go by the calendar year. Not positive though

Are visas number automatically available to spouse of US citizen?

Yes.

When your case is recieved and pending what should or can you do if it has not been touched for weeks on the USCIS website?

Nothing. Being touched on the website means nothing. Many have been approved and their case status was never updated. Do not do anything until you are outside of processing times.

What could be classify as a potential age difference between a US citizen and his/her spouse (the beneficiary), is there a age limitation?

There is no age limitation. This usually only comes up at the interview stage. It comes down to what is considered culturally acceptable, for example if the consular officer has reason to suspect the marriage is a sham they may consider a much older woman marrying a very young man from an African country suspicious.

What is the implication of a first-in-visit marriage and a short courtship which preceeded into marriage and the possible decision of a visa interviewer in such a case? How long can a marriage couple lived together in the foreign spouse country before the interview date at a US consulate or Embassy in other to establish a evidence of bona fide relationship?

You don't necessarily have to have a long history of living together to prove a bonafide relationship. You should be able to provide many different types of proof. Photographs, emails, phone calls, visits all give a more complete picture.

Does the spouse been pregnant makes am Entry clearance official to grant a visa?

No. There have in fact been times in some countries where the child needed to have a DNA test to prove that the US citizen is the parent. Pregnancy is not considered a proof of a bona fide relationship and USCIS will not consider it a reason to expedite. Some people have gotten more consideration from NVC and the embassy but again it's not guaranteed. Please do not consider having a child to make the visa situation easier.

Can the petitioner be present at the interview in the foreign spouse country when he/she goes for interview.

That depends on the embassy. Someone going through your embassy will be able to help you better with this.

The 5 months only reffers to USCIS processing time. You should expect another few months at NVC after that. By the way, nothing is set in stone as to the time frame. Some people wait a couple of weeks while others wait the full processing time. Oh, and hope to God you don't get a Request for Evidence, which may also delay your case by a couple of weeks. Hope this helps

Imaisha......... thanks for your reply. as for the age thing im 33 and gonna be 34 in november and my spouse is 25 last may and he is from nigeria, and i am moving to nigeria to stay with him in august do you think we may have a problem because of the age? we met online while he was studying in malaysia and we only court for 1 month and 3 weeks before we get married and we lived together in lagos nigeria for 1 month and i went back to the states and i pleaded with my spouse no to go back to malaysia where he study simply because he will be attending his interview in his country of citizenship and since its also likely that he wont be completing his diploma in malaysia before his case will be approve, he already had a diploma in banking and finance in a nigerian polytechnic and he is undergoing his second diploma in business administration at a malaysian college which is going to be completed in 2011 and we just cant afford to stay away from each other for that long so we both mutually consented to it that we forgone the study at malaysia and another enrol can be made while we got back to the states, because i have decide i am going to stay with my spouse until the visa is granted and we all go back home with our son who will be with us. does any of this poses a problem or serves as a threat of denial or to view our marriage as a sham?

5 months is processing time at uscis nowadays as it is shown on the web site,

every consulate got specifications about age differences according to the tradition in your country which i don't know,as for arab they consider 10 years (woman is older) is suitable otherwise they begin to be nasty in order to realise if it's a sham marriage,

if you got what to prove for the relation so good luck

CR1 and Nigeria you should consider the process to take a year. Consider anything quicker a bonus.

USCIS 6 months

NVC 3 months

INterview date 2 months.

if you wait for 5 months and you don't here anything fro USCIS, write your problem to CIS OMBUDSMAN. ( google it and you will ind their website). They definitely hel you resolve your case.
