WHAT'S NEXT? I am already here in the US through K1 visa.

Hi everybody!

I am a Filipina and I am already here in the USA. I arrived here on June 10, 2009. We actually hired an attorney because my fiancee wanted it since he's working, though I really didn't want to cos I know that most of the visa filers prefer to just do it themselves in order to save money and it's not that really difficult. And besides, I believe that this website is very useful and that there are many members here who are knowledgeable enough to give advices. ;)

Anyway, my question is what should I file now after our wedding? What are the papers that I will need and where will I go? I told my fiancee that I will try to gather data first because as much as possible, I don't want him to hire an attorney to spend money for their service. I prefer to keep the money and buy ice cream and cake for us! :D

I hope that you can help us. We are located here in Phoenix Arizona, USA. Our wedding will be this Aug. 7 in Iowa because most of my fiancee's family, relatives and friends are there.

I'm sorry but I don't understand what's the meaning of this one above.

SSN stands for Social Security Number right? Is it right that I could only get that SSN after filing the AOS?

Your post was moved to the correct forum.

Yes, SSN stands for that. No - you can get the SSN now - go to your local SS office and apply.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

My question is, are removal of conditions and naturalization not included when we applied for AOS?

If you are married less then 2 years your green card has a condition that it must be renewed in 2 years. If you are still married after 2 years this condition is removed and it becomes a 10 year green card.

Naturalization is the process of becoming a US citizen. It is optional and an entirely different process

I don't believe either is part of AOS.

Please read the guides on this website about AOS, removing conditions and naturalization. Your next step is to get your SSN which you can do now, get married and file for AOS (The guides on this site explain the process and provides step by step instructions so you should be set to go with those). AOS is 'adjustment of status" in which you will go from a K1 to having a permenant resident card (green card). When you file the AOS you can also file an EAD (employment authorization document) and AP (advanced parole) which enables you to work ( The EAD) and travel out of the US (AP) before youre green card is approved. THe EAD and the AP are optional and depends on your personal situation and finances (as it costs more than just the AOS fees). Since you are K1 you will get your green card (usually) before two years of marriage, which means you will have a conditional green card which is valid for two years from being issued.

90 days before the green card expires, you will apply with your husband to remove the conditions on your greencard which will have the outcome of a new 10 year card.

If you wish to, on or after the third aniversary of your first green card you can apply to naturalize (become a US citizen) which is optional and is a personal choice. Please read the guides for more information about everything! Good luck.

I just have a quick question and I appreciate everyone for reading..

After we get married while we are applying for AOS, say the processing times are longer than the 3 months we get to marry...Does my Fiancee have to leave the US? Or can he stay here while the case is pending? Thank You all for your time.

Your fiance would come to the US and you would get married within 90 days from entry and then adjust status. Processing times vary from then on. Your fiance DOES NOT leave the country at this time. When you apply for AOS you can also apply for an EAD (employmeny authorization) and AP (advanced parole to be able to re enter the US after international travel). EAD and AP are an extra cost and are optional. You two would then reside in the US until an interview for the AOS happens or you are approved from the service center at which point he will recieve his GC. Hopefully this helped - read the guides for more info.
