Okay, will try to condense this as much as possible. My fiance is in Ukraine. My first marriage was with a fiancee visa, did not work out. Went through fiancee visa with someone I met in Ukraine, filling out all paperwork, sent it in last year. They approved it at service center, was sent to embassy in Ukraine. In December she had her interview, everthing SUPPOSEDLY went well. They told her she was approved and would receive her visa in the main within 10 days.

But after more than 2 weeks, we called and they said it had been sent back to the service center in America with the recomendation for denial, would not tell us why, just that we had to wait for the letter of response from the service center.

In checking online case number, it was up for review in January and could take normal waiting time as if it were an application from scratch. Well last week I got a letter that said this...

"This is to advise you that we have reaffirmed our previous decision on the above application or petition which the Department of State had previously returned for review. We have forwarded the case back to the Department of State for action."

Anyone have any experiences like this and know what this means? It sounds like it is being sent back to the embassy and they should never have sent it back recommending a denial. Idiots there even lied to my fiancee while she was at her interview. Does this mean they will contact her to come in for ANOTHER interview? Does it mean they will just send her an approval based on what they should have done before? Will they just inform her of the next steps? Where do we go from here? Any advice would be appreciated. How long ago was the first fiancee visa? Did you meet the IMBRA requirements (if applicable)? (curious if this could be why the back and forth).

Not necessarily so, it may of been recommended for approval, but after the interview, someone higher in the chain kicked it back.

Does this mean they will contact her to come in for ANOTHER interview?

Probably.

Does it mean they will just send her an approval based on what they should have done before?

Probably not, some things may of changed since the first interview, and they would probably need up to date info from you.

Will they just inform her of the next steps?

Yes, and they should inform you too. I would be getting in contact with the embassy and find out what is going on, since you have the letter from State.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Well, I am not calling anyone an idiot. Consulates CAN do AP after the interview and apparently something caused a problem. In general I have been happy with Kiev, but they are not perfect. So yes, it will make its way back to the consulate and then you can make an interview. I would not wait for them to contact you. Download the forms and get everything ready and as soon as they have your case, call and make an appointment. Kiev is running 4 days lead time on K interviews as of this morning. It normally takes 2-3 weeks for the case to go from the USCIS to Kiev and get entered in the system.

Here's a little tip to save you some $$$ Call the call center and when the voice message prompts you, push the number for buying a PIN. The person (Viktoria or Vitaly) will answer and ask them if they have your case number in the system. If they do, buy a PIN and call back to make appointment. If not, try again in a few days. You won't be eating up your $12 PIN numbers. Tell Viktoria Gary said "Zdrastvootye".
