I have read in a few posts that July and August are the worst time to apply for a visa and it takes longer. Is there any validity to this theory? When are the best months to file an application?

Hmm... you could say the same about any time of year. Are you talking about the USCIS stage? December is bad as the holidays mean a few weeks off. April is bad because the H1b applications come in and they take preference over our applications. I'm not sure there is a "best" time.

Hmm... you could say the same about any time of year. Are you talking about the USCIS stage? December is bad as the holidays mean a few weeks off. April is bad because the H1b applications come in and they take preference over our applications. I'm not sure there is a "best" time.

I'm not so sure about that. Just do it as soon as possible, and don't lose any time thinking about it.

7.30.07 - Received NOA1

11.21.07 - APPROVED!!!! APPROVED. GOT AN E-MAIL ON THANKSGIVING!

03.03.08- INTERVIEW IN CIUDAD JUAREZ. VISA GRANTED ON 03.03.2008

***AOS & EAD***

3.10.08 - Case Received at Chicago Lockbox, check cashed 3.14.08

3.17.08 - Received both NOA's in the mail

3.21.08 - Received Biometrics appointment letter in the mail, biometrics Appt. 4.02.08

5.05.08 - EAD Card Production ordered GOT EMAIL (we received the same email on 5.09.08)

5.13.08 - Approval Email for EAD (so the card was ordered first, and then we were approved...hum)

5.15.08 - EAD Card Received in mail.

8.08.08 - WE GOT OUR INTERVIEW APPOINTMENT YAY...9/12/08 - INTERVIEW APPROVED

9.24.08 - Received Green Card in the mail YEAH!

***I-751***

6.15.10 - Mailed I-751 Docs to CSC, check cashed 6.24.10

6.26.10 - Received NOA in mail dated 6.21.10

6.29.10 - Received Biometrics appointment for 7.15.10

Essentially, there is no good time to embark on the K3 visa path. It's really an obsolete visa. However, "applying for a visa" is something you do after a petition is approved, so the best time to apply is as soon as you are invited to do so. Why would you delay? Now, if you're really asking when the best time is to file an I-130 petition, which is the first step anyway, then the sooner the better. The time you delay will never be recouped.

What would you do if you were ready to file in August and I told you petitions filed in January result in a visa process two months shorter than when filed in August? Would you wait five months to file the petition?

We tried to file our petition as soon as possible after my husband's departure from the US (on VWP). Unfortunately, we had an attorney who sat on it for what felt like FOREVER. I guess since he got to go home to his spouse every day after work, he can't possibly understand our agony. :whistle:

We had to hire a new attorney & finally got the petition filed three months after my spouse left the US. We were trying to minimize our separation as much as possible. Perhaps that's why you're asking -- so that you can visit & then file as soon as the foreign spouse leaves for home?

I'm glad you asked, though, because I was curious about this as well. I wouldn't have waited to file, but was curious just the same.

AFM, we are at about 24 days post-petition with no NOA1 yet... :unsure:

8/31/12 - AAO appeal sustained (THANK YOU, GOD FOR YOUR MERCY)

10/8/12 - USCIS sent file to Consulate

11/28/12 - Visa in hand

12/10/12 - HERE AT LAST! (ALL GLORY TO GOD!)
