Does anyone know if the joint sponsorship can be ended in the future if the petitioner is later making enough money to sponsor the immigrant alone? I just finished a graduate program and my 2008 tax returns do not show sufficient income. I am currently interviewing for teaching positions, and once hired will exceed the income requirements to solely sponsor my husband. I don't see the point of locking someone else into ten years of sponsorship, if all we need is one.

Please let me know if you have any information about this!

Thanks!

I could be wrong but once he gets there and you move to adjust status you can take your co-sponsor off and do it alone provided you exceed the poverty line at that point. However if you don't need a persons assistance does it really matter what it says on paper?

Good Luck

Good Luck

The last post sounds about right. I freaked out and thought I needed a co-sponsor but then did it on my own. I am a teacher too and took a year off to wade through the paperwork for my Fiance and spend time with him in Nicaragua. I see your from Ohio. Me too! I just took my new Husband to visit my family there. We had a great time. Off topic...sorry. Good Luck with your journey. Once you have a salary you should be cool but you do have to submit the last three years of taxes for Adjustment of Status, keep this in mind.

No. Not if it is for the AOS. The sponsorship you provided for the visa ends when you adjust status but if you need a co-sponsor for that they are "on the hook" until the end of the sponsorship period. It ends when the immigrant becomes a citizen (if he becomes a citizen, which he can do in 3 years) or after 40 quarters (10 years) of participation in the SS system, either by working himself or by being part of your joint income tax return. OR if he becomes divorced and leaves the country and surrenders his green card (or it expires and is not renewed).

If that sounds terrible, remember the joint sponsor is ONLY liable for the immigrant if they become a public charge and file for welfare benefits, it is generally a pretty small risk. The joint sponsor is NOT responsible for any other debts or liabilities. If he defaults on a credit card, it is all hers!

That does make me feel a bit better - my Dad was our co-sponsor for the K1 and I am sure he will do it for AOS as well, but it's hard to ask other people to be responsible for your life decisions! BTW - what does "become a public charge" entail? If, hypothetically, someone else were to sue us and we didn't have the funds to pay, would my joint sponsor be held responsible? Or if there was a medical emergency that our insurance didn't cover? I am just trying to figure out what all the stipulations are.

No, the co-sponsor is only responsible for basic necessities like food, housing, and clothes...that are it! The medical emergencies are not part of the co-sponsorship. They are not responsible for your bills, credit cards, or debt (weather it is from a lawsuit or something else).

Good Luck :)
