Regarding Income and Tax returns !

Hi ,

I have my AOS interview in Mid july. Now my wife(USC) has to filed for the taxes as yet and is on a extension till Sep.

a)So what do we show at the AOS interview if he officer asks for tax returns ?

Also she is on a state teachers pension which shows below poverty level. So we added money from the housemaid to show it much above the poverty level. We didnt show it in her last tax returns. And we didnt get any RFE as we showed the current income as the addition of both the moneys. We attached a copy of the housemaid contract.

B) So do we take the same contract atthe interview to show the interviewer ? Will we have to have to report this income to the IRS ??

Hi Christera22,

We filed for the taxes jointly as well. So we are taking the 2008 Tax returns documents as proof of joint filing. Although you didn't get a RFE as yet,(neither did I) but they might ask for joint filing or 2008 filing during the interview, if they find it missing in the file. We filed for an extention too, since I didn't have a SSN and could file for taxes, but as soon as I got it, we filed. Why are you delaying the filing. You have your SSN. Its good evidence.

About your housemaid's income. I dont think you have to show it in your taxes to the IRS. But since you wanted to stay above the poverty line, did you attach a Co-sponsor affidavit to the I-864? Thats the proper format and they surely will ask for it during the interview.

Thanks Saspak........... she is delaying applying for it as because she doesnt have everything arranged. Now with the I-864 as i said we gave her last 3 yrs tax returnswhich was below and at the edge of the poverty level. But we wrote the current income to be much higher adding our housemaids income with it. We attached a copy of the housemaid contract with the I-864.

Now my query is say for example we file and we take the recent tax returns to the interview and then also show them the housemaid contract (notarised)......................will the officer accept it or will he ask why didnt we show it to the IRS .

any advice on this ???

I dont think they will question you whether you have reported your housemaid's income to the IRS. Not their concern. Thats for the IRS to figure out and for your Accountant to handle when filing. USCIS is more interested in a continuing relationship/interests and co-mingling of assets.

What I am saying is that they wont care if you have reported this addtional income to the IRS. I dont even think, its reportable to the IRS since its another persons income you are showing in your I-864. USCIS might question you for the delay in your latest tax returns during the interview, and ask why you filed for an extension. Your SSN could be a reason, but now that you have it, you could file together and add another point to your case. Am not sure if your housemaid's income will be acceptable unless she is willing to Co-Sponsor and give you the affidavit of support. How have you added the contract and her income to yours? Thats what I am trying to figure out.

what we did is with the I-864 we attached her last three years 1040 and simple tax transcripts from IRS. Which actually showed her below poverty level. We also attached a notarised copy of the housemaid`s contact which indicates the monthly rent. We added both the figures and put it the current household income line of the I-864. ( one from 1040 and yearly income from housemaid)

I do not understand your question - who is the housemaid? Your wife working as a cleaning lady or something like that? If she is generating income (from any sources) it must be reported to the IRS and taxes including SS has to be paid on it.

Why hasn't she filed taxes yet - people with just pension income do not have a complicated tax returns and any H&R block or Jackson Hewitt office can do it if you two are not comfortable doing it.

You can't just hide your 'other' income just because it was paid in cash either - that's considered illegal (I am assuming its substantial - not just 5 or 10 dollars). And if you are going to try and show that income as additional income to meet the poverty line (+125%) then you may have more issues than just hiding income as you are trying to claim it as income - I will not advise you to do that.

Best thing is - Be Truthful - declare all your income truthfully and pay the additional taxes that may be due and then claim it as part of your total income to meet the poverty level. Good Luck

Ok to clear the confusion by housemaid I mean the renter whom we have rented our 2nd floor. She hasnt filed taxes yet because we have lost several of her bills and stuff in a fire. So she ia arranging everything. No the rent is pais by cheque. I think we have to arrange a cosponsor and take the cosponsor form with us in the interview.

motu mis-understood the question. Yes, Christera22. You will have to take a Co-sponsors Affifavit of Support on the prescribed form. Just submit it at the interview since they have not sent a RFE and surely will ask during the interview as its initial evidence. I would still suggest, try filing the taxes so that you can show joint filing at the interview. It would surely go to your benefit. I am sorry to hear about the unnecessary delay due to the fire.

PS: motu, maybe Christera22 should have used the word Landlady. Maybe thats where the confusion arose.

so you have a renter and rental income - you need to include that as income and pay taxes on it. As I said before, go to a Jackson Hewitt type place and they will help you do it. No need to delay filing taxes; if you have lost bills and stuff - were they for repair of the rental unit? - then you have choices - you can 'recreate' the bills by estimating - again Jackson Hewitt type places can help you do it. Bite the bullet and estimate your expenses and do it. Good Luck

Thanks Motu. No the bills were her own stuff .....nothing to do with the rental unit. So you are saying if we show , atthe interview, that we have filed for an extension, they wont be happy ??

Any idea what kind of tax wd a rent of $600 incurr ?? Thanks ...... those kind of tax organisations charge huge so she might try to go back to her original attorney.

A few things need to be answered.

You say housemaid, to add income the housemaid needs to be a household member and would provide an I-864A to add that income, if not then the income cannot be added. A Joint Sponsor would be needed.

As for B ) this is between you and the IRS, the Interviewing officer will want documentation for all the numbers on your I-864.

Again I would do up a proper I-864, and get a joint sponsor to also do an I-864. Hopefully the interviewing officer will allow you to provide corrected affidavits of support.
