i am selfemployed and didnt claim enough on my returns 1040 and am thinking about amending them. has anyone else done this? Will it throw up red flags or is it ok to do? I know I'll have to pay more. I can prove income by contracts and reciepts. Do you think that the consulate will think I,m a "deceptive person" or just your typical contractor?

Line 22 had 9131 on it. I am going to file k1. I know that is too low for i-134 and i-864. I also read on official goverment websites that I can amend my tax returns and it will theoretically be ok, but theoretically and what the consolate thinks are two different things. I am not sure if they will think if I'm a dishonest person for under reporting on my taxes as most of my customers don't give me 1099's. Will coming "clean" do me any good or just result in a refusal, after all how many waiters, politicians, or contractors actually report every tip, kickback, or job? Surely I don't want to wait another three years to do tax returns. I've got myself in a pickle!! I accept responsibility for my actions and that would show by amending them but I just am scared that I'll do that just to hear DENIED. And I have been running all checks into my account since 09 to show true income.

Yeah low. As a contractor I know just what your talking about! I don't think dishonest but maybe a red flag for uping it? not so sure. if you do amend your going to pay a small boat load to the IRS im sure someone will let you know?

Who cares what they think? Do NOT file an amended return. It isn't about "red flags" it is about why do you want to pay more tax than you are required to?

There is no requirement to meet THIS year's guidelines with LAST year's income. I wouldn't change a thing.

What you need to do is establish your CURRENT income as being adequate. People are allowed to have good years and bad years. On the I-134 it asks your CURRENT income, no tlast years income. The best way for a self employed to establish this is to take your deposits to your persoanl bank account, year to date, divide by the number of months and multiply by 12. Add any known additional income. Attach copies of contracts if you like.

Attach three years income tax returns IF it helps your case. I doubt it.

This is a case where a bank letter stating last 12 months deposits to a personal account(s) is very helpful.

Other option..incorporate your business, you can do that today (Monday actually) and "hire yourself" as an employee of that business and pay your self a really good salary and state that as your CURRENT income. It is perfectly legal and ethical. Of course it obligates you to withhold payroll tax and send yourself a w-2 at year end and meet all the other statutory requirements of being an employee. As a priniciple of the corporation you would be exempt from Workman's comp insurance, and unemployment insurance premiums

The IRS will gladly accept an amended return and more of your money. Obama will use it to stimulate something in the economy since you, presumably, cannot be trusted to spend it and stimulate the economy your self (he really does not understand my wife!! The best stimulus plan he could have would be "Let's take $3 trillion and give it to Alla, she will stimulate the economy and all will be saved!")

But it is not necesary. This is absolutley not a reason to give more money to the government. Think of the case of a student...made $9000 last year but got a new paying $45,000 per year this year. What's the problem? Stop running around trying to figure out how to make more money LAST year!

My presumption, having done this for many years myself, is that he has claimed as business expese many allowable items for business use. Perfectly acceptable and legal. It DOES reduce your personal income and tax liability (that's the point) but then when you have to show income for a particular purpose, it comes back to bite you. Try to get a home mortgage, at least now. But lots of times that is not an issue for someone.

I understood it was his intent to file an amended return, NOT claim the legitimate business expense (or some of them) thereby shifting the income from the business to himself and increasing (by a whopping amount) the tax due.

If it was an "Oops, I forget about that contract" and there is additional, real, income then you have to file an amended return.

Do this make a letter, "Projected Income for 2009" base this off your bank statments and furture contracts/jobs not your 1040 be real don't game it.... Keep it to one or two page at the most then put it in Affidavit form.

I am a a sole proprietier of my business, rent a house where i can claim some of the expensies, I have only one truck I use for work and personal use, buy a percentage of clothes for work and so on. I am a small fish and its very hard to see where my business "stops" and I begin. If I was totaly trying to get one over I'd only claim the 1099's that were handed to me. In such a case I'd probably claim a loss and get money back. I think self employed people can understand what I'm saying best-especially small fish. In response to Gary's comment about only show bank statements and last years tax return for i-134 that would probablly or possibly work yet when we have to adjust for i-864 that is when I am not sure. I know that after my fiancee gets here, we marry and she gets a wp, she will get a job. That should help with i-864. I just don't want her to come over for three months only to have to go back to the "land of smiles" married, alone, depressed and devistated. I appreciate your responses. I think Monday I will contact an attorney and get their advice, at this point its more of what not to do than what to do as I am more than capable of filling in lines on a piece paper.

P.S if I were to go to get anything from the government I'm 99% sure they would look at my total gross and tell me to go away as they should.

Good advice, but not necessary. The form asks for CURRENT annual income. No need to write a letter. Just project your current annual income basing the projection ond documented evidence. If you made $30,000 for the first half of 2009 it is perfectly plausible to state your current annual income as $60,000. If you have some big contracts or other unusal forms of income coig later in the year, add that to the figure. Support it with last 12 months bank statements, which to a self employed person are the same as "check stubs". Remember it is PERSONAL income not business income, they want to see.

For the record, no one is screwing anyone (not as I read it) this is perfectly normal and legal business accounting practice.
