i actually came to usa for my examination. i have already scheduled my exam. i came to us even before and took the exambut failed it twice. this was the 2nd time that i came to usa for the exam. meanwhile when i was here for the first time i met a girl on internet and then we started to chat togther on phone. when i was coming for the next time i moved in with her and ended up marrying her with in 8 days. what should i do. should i apply for adjustment of visa status . because certain lawyer says that it will be considered as visa fraud and they tell me not to file for adjustment of visa status.

Technically it is only fraud if you entered on the B2 with the intention of marrying and staying. But whether they will believe you that this wasn't your intent, I don't know.

Your options would be to stay and apply for AOS or go home and apply for a spousal visa. There are two different types. If you click on the link at the top of the page for "Guides" you will find a few that might help. The link for "What visa do I need?" does not have anything about AOS, but it does have comparisons of CR1/IR1 and K3 visa process. Below that, under "Guides if you are married" there are links for guides for adjustment of status and both CR1 and K3 visas.

Another thing you might want to do is look on the branch for adjustment of status from work, tourist, and student visas. You will find people on there with similar experience to yours to get a better idea.

Nobody on this earth including myself can buy "Getting married after 8 days you move in with her".

I can imagine your AOS interview, IO is probably gonna ask you as follows :

- How have you met her ?

- When have you met her ?

- How long have you guys known each other before you got married ?

I don't know about the other exams you have taken but I am very sure you can not pass this AOS exam.

You ended up marrying her in 8 days? Why? What was the rush?

One can never know what the USCIS will do, but in this situation there will be a huge burden on you to prove that you did not intend to immigrate when you entered the country. You mention "exams" - are these exams that have something to do wtih working in the US? If so, that isn't going to look good either.

Unless you left behind a permanent job, and a family and a house, etc., I think you need to go back home and apply for an immigrant visa.

Similar situation to yours. Only in my case, I knew my wife for a almost a year. Came and met her twice. Then her father came to visit my family. I had come for the Nikah on a B-2 and yes the intention was to get engaged. Not to adjust. But in my case, I have my business that i still operate from here since i never had expected that i would end up this way. I had just bought a house back home that is still vacant and waiting for my return. My bank accounts and credit cards are still being operated by me here. Seven months and i still dont know what to do here, despite having my EAD card at hand. I decided to adjust status after we found out that my wife is expecting. Wont hire a lawyer and will face the USCIS head on! In the end, you know what your intention was. File from here, or go back and file from Pakistan. Things aren't looking good there. You might end up stranded there for years. I didn't want to take that risk, knowing that I am about to be a father. Good Luck To You. I took the Risky route. One thing i do know will determine your case, is if you have any compatibility with your spouse.

I know one thing for you & Troubled Couple is going to be a long, bumpy & rough journey.

But look at it in the bright side, at least you are together with your expecting wife & very soon your baby too.

Even if you wait for a long time, the family won't be separated !.....
