We received an RFE today saying:

"The record shows that over 12 months of time has transpired since you were medically examined in conjunction with your K1 entry."

So we're asked to submit a completed I-693 filled up by one of USCIS' appointed civil surgeon.

We had our medical exam last April 23, 2008 in the Philippines and submitted AOS on March 24, 2009, they received it on the March 26th. We know it was close but based on what's in USCIS website we're good as long as we filed within the 12 month period.

Now, I need y'all opinion about what I need to do here. We called the misinformation line and the lady said that we can schedule an infopass but since it has been over 12 months since we had our medical exam, we may still be asked to get the exam again. So should we just go ahead and get the exam? The thing is, money's tight here right now so we're trying to avoid spending if it's not necessary.

How is your risk tolerance?

You get one chance to submit evidence on an RFE.... You can fight it and you might win.... If you lose you start over.... So you need to assess the risk of a loss or just biting the bullet.

Very low. I really don't like taking risk with this kind of situation. :(:crying:

Ok, so I receive the RFE letter for my son today. And it's saying:

Tuberculin Skin Test: Current regulations now require that the tuberculin skin test and/or chest X-ray be completed by all applicants 2 years of age and older. Your Form I-693 reflects that you have not had a tuberculin skin test or chest X-ray performed.... (and so on and so forth)....

Now, I'm confuse whether my son will have a complete medical exam or just the skin test. On my RFE letter, they said I need to have complete one since my medical exam was over the 12 month period (so as my son) while on my son's RFE, they didn't say that he needs to have a medical exam, just the skin test.

We decided that I'll just get a complete medical exam again as asked by USCIS, but should we get the complete medical exam for my son too or just have the skin test as asked by USCIS?

the I-693 Part II Item 5 is the vaccination part... have that part filled out or whatever part deals with the specific RFE situation

We called the misinformation line. My husband called 1st and wasn't satisfied with the lady's answer cos she's just telling us what we already know, so he asked for a higher level and won't let the lady transfer him so he got irate :blush:

So I called them and was nice enough so they gave me an immigration officer to talk to instead of just the customer service rep. Then explained to me my case and everything. I was satisfied with what I heard from her, with the explanation she gave me and all.

The immigration officer was right, "Give the USCIS what they want, no more, no less, avoid any problems.", so we'll give them my full med exam and my son's TST. Hopefully they won't asked for my son's full med exam after we'll submit his TST cos they only asked for TST.
