OK, the last time I called USCIS a few weeks ago, to get an update on my I-485, the officer told me that they had my Biometrics on file and everything seems OK. Now they are just waiting for my Local Office to have an opening for interviews.

Today, I called to check case status update and as usual after being escalated to a higher level, the officer tells me that they are waiting for my biometrics results. Thats whats holding up the case. I asked, how soon would they hear regarding my background checks. To which he replied, it depends case to case. Now this is absurd. One guy tells me that everything seems to be OK and my case is just awaiting an opening in the local office. The second officer now weeks later tells me they haven't received my Biometrics and thats whats holding up my case! In such a case, what am I supposed to do? How can I check, if my FBI background check and Name check have been processed and sent to USCIS? Also, if USCIS didn't receive Biometrics results(which were done in March) how did they authorize my EAD card. How did I get cleared for the SSN? Can anybody tell me if the officer could be right?

Sorry to hear that you are getting these conflicting and confusing answers. Since talking on the phone does not help, why don't you try to set up an info pass appointment so that you

can talk to someone face to face.

Someone posted on here a while back about how your nationality and sex may affect how fast your application and background check are processed. I don't know if this is the same

case with you. But the good news is that you got your EAD so im sure they have your finger prints on file.

I would say that the IO who said they're still waiting for you biometrics is either making something up to placate you or doesn't know what he's talking about. I think that in order to receive your AP and EAD they have to have your biometrics on file, after all, the picture that they use on your EAD is the one they take at the biometrics!

I would make an infopass to talk to someone about all this.

Thank You for your reply. Trust me, my background and ethnicity does fall in a category that would delay/prolong the background checks. What I would like to know is that If they say that they have the Biometrics in file, does that mean that the FBI checks/Name checks have been done and received by USCIS, or Biometrics is just the finger-printing record and has nothing to do with clearance?

Thank You! Was pretty embarrassing being tested for driving. Somthing that I have been doing for more than 20 years now:) I was thinking about an INFOPASS, but most of the topics that i read here are discouraging me, since I have come to the conclusion that even face to face, these USCIS officers aren't in a mood to help you or answer your questions. I was under the impression that Biometrics is for the background checks. And once they are done, the findings are sent to USCIS for further action. I thought the same, that probably the guy didn't know what he was talking about or could explain the delay, so he just made up this story of background check delay.

well, I went for an infopass twice. The first time the IO was surly and rude but the second time I got a different officer who was really nice and understanding. If the office isn't too far out of your way I would say it's worth it to go down there for a visit and take a list of questions to ask with you. I think that the fingerprints they take for biometrics are the ones that are sent to the FBI for background checks so they should definitely have your biometrics on file at USCIS.

Thank You chantpleure! I'll try to muster up the courage and visit them. Its not really that far from my place. Can take the train straight to Federal Building in Manhattan. I guess you are right. Have to ask them about my I-130 as well. My application is almost close to the 6 month mark which is the processing time for CSC. How is your evidence gathering coming along?

Well, we're still putting stuff together. We've asked our landlord to give us another lease as the one we sent with the AOS was dated to expire in Jan of this year, on that lease I was listed as an occupant and not a lessee so on the new one I should be listed as a lessee. We're going to bring several photo albums of pictures of us with family. We don't have any pictures of the civil wedding but we do have some of the after party. Other than that, we're just putting together everything they ask for and trying to track down the originals of things.
