Hello,

I have been away for a few weeks getting things done.

I have Paid all fees through NVC and have submitted no documents to them.

I have yet to receive a response from the IRS to get ITIN number for my spouse so I cannot submit the AOS until all my taxes are complete for the past 3 years.

Called NVC and they advised I can send DS230 and supporting docs anytime (even prior to AOS).

Just wanted to Verify what I have ready to go and what I am missing. I will be submitting eash in individual envelopes then packaged together in one larger envelope.

Hello,

Yes you look good to go. I did not include photocopies and never had any problems. I did write the Case numbers on small post-it tabs and stuck them on all the original Docs.

Hope you get your tax papers sorted soon.

I hope so too. IRS didn't accept my POA for my wife. My mistake I guess, they wanted the POA from their site to be used. Had to resubmit the W7 and about one week away to get the ITIN. Then I have to file my taxes for 2006 & 07, and I can send away the AOS.

Unless you can obtain additional "originals" of any documents when needed, you should send only photocopies to any government agency. Otherwise, your list is very complete. As far as the ITIN, it can take 2-3 months after filing for it to obtain a piece of paper from the IRS telling you what the number is. Unless you filed a joint tax return, the ITIN was not needed anyway. If you did file jointly, and your refund has been issued to you, then the IRS can provide transcripts of the most recent three returns and the ITIN is not needed to obtain them.

Birth Certs and Marriage Certs can be obtained for a small fee in Canada very easily. As for the ITIN, 2008 is the first year I have filed in the USA (Long story) and I am filing jointly as I have been married 11 years. I was also told that I should not file single as Immigration may see this and may raise some red flags. The ITIN number, I should have within the week as it is processed prior to the IRS filing my 2008 taxes (W7s submitted with 2008 return). Once I receive the ITIN number I will file my 2006 & 2007 taxes. Once filed, I will request transcript for 2008 (as this is the only year required for transcripts to send to NVC). I do not need the transcripts for 2006 & 2007.

Sending only photocopies to the NVC is not an option, you must send the originals. they will be returned to you at the interview.

I filed a joint tax return along with the W-7 aattached to the front of the return (maile it 4/14/09). I recieved the ITIN letter on Friday May 22. Not sure where you sent yours to... I'm in California, but I would imagine you should have it soon.

POA - Power of Attorney

Sent mine to the correct place (in February), received my 3 kids ITINs within 4/6 weeks.

My wife's they did not accept as I signed her W7 (also submitted original POA)

The IRS does not accept any POA but their own from the website (my mistake) had to resubmit the w7 End of March.

Well that is interesting about someone telling you should not file 'single'. I too had never filed a U.S. return - I filed Married filing separately. There were no red flags associated with this at all.

I assume since you have been in Canada for a number of years that you and your wife only have Canadian income? Can't see why anyone would think that would raise any flags at all. You guys have been married for what, 11 years?

Looks like you're organized! I'm sure you've already seen this wiki guide, but check it out if you haven't yet, it gives valuable information on exactly what documents you need:

Here's my tips, I'm sure everyone has some for you!

-Don't forget to write the name & date of birth on the back of the passport pictures

-Don't forget a cover letter! That way it's easy for the NVC to find all the papers and not lose them...

-Definitely write the NVC Case # on all papers (for original documents, put a little sticky note with case # on it)

-I would get photocopies, they had all mine at my interview, and kept them all

-Get original "certified" copies of marriage certificate, and birth certificate. That was the only originals I sent in.

-No you don't have to use their envelopes...I sent my stuff overnight so it would get processed faster (did it help? Questionable :huh:)

Good luck!!! NVC is usually pretty quick, so you're almost done! :)

First, Thank you for your response!

Here's my tips, I'm sure everyone has some for you!

-Don't forget to write the name & date of birth on the back of the passport pictures

I was advised by NVC to have only the case number on the back of the passport photos

-Don't forget a cover letter! That way it's easy for the NVC to find all the papers and not lose them...
