My question is on main reasons for cr1 denials.I filed for k1 before was denied because CO did not accept a co-sponsor in the I134 and i did not meet income so i have to use co-sponsor that was qualified but CO ignored my co-sponsors I134 and denied petition as public charge.Now we are married and filed I130 and got approved case at NVC and has a qualified joint sponsor on the I864.We have age gap she's 43 and I'm 62yrs old.

I also have petitioned my ex-wife before in 1999 got divorced 2005 when she got her papers and I feel my ex-wife had used me to come here.Divorce is one of the most painful experience I had in life and now that I have found somebody that loves me this immigration process has given more stress in the last 2 years.Anybody have similar experience for having to petition twice and was approved.This is a real marriage but since it is the second time I'm worried.You guys see any red flags for the interview in my case.Appreciate any advice and feedback.Also is it true that Manila does not accept co-sponsors for I134

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

You wife just has to explain everything asked, and if she brings sufficient photographs, proof, and is knowledgable about the previous divorce, etc, she will satisfy the questions at the interview and should be issued visa. Age difference is not that big a deal in foreign marriages as they are common, my husband is more then 10 years older than me. Mainly the CR1s get denied if there is fraud, especially on the side of the beneficiary. Other than that, cases that have straightforward answers to questions from the CO and have lots of evidence of ongoing relationship (pictures, e-mails, ets) are rarely denied and sent back to the US. Wish you the best luck in your journey, keep us posted.

Thank you Tammy but my concern is I only have 3 pictures since I lost my camera but I have emails,chat logs and money transfers for 8 monthly transactions.My wife is a nurse with a completed employment visa at NVC but is under retrogression now.She also has a signed contact with a facility that would pay us back all expenses for immigration,airfare and moving expenses once she gets here.Will I let her submit this at the interview?I hope some experience nice people here in VJ can help me with some advice.Lots of scary stories here.Please advice..Thank you all...

Hey there,

I am not so informed about whether this fact will effect the visa process, but it should not as long everything is explained thoroughly in the interview. The three pics is not bad, bring the chat longs and transactions and again, tings happen - what if you made a wedding video and took no pics only to realize they don't allow media during the interview? So things like that happen, do not be too worried. I think you should just prepare your wife with several questions such as where does your husband live, what does he do, what happened during his past divorce, when did you meet and what are you goals in the US careerwise, how long have you met and details about your job and hers. The CO only denies when there is insufficient evidence of a bona fide relationship and when there is suspicion of fraud. These two things can be cleared during the interview and if your wife's english is good, I recommend she take the interview in English and answer the questions slowly and clearly, and the CO should not give her problems. AP is mainly for males so you have a good thing going on. Yes there are scary stories, I for one had to wait 13 months after my husband's inerview to get his visa. But usually again this is for males - most females get through immigration without problem. Just do a shining job at the interview and always keep in mind, God will guide you and is guiding you and your wife right now.
