Hi,

Me and my fiancee were just engaged on the 2nd of May, She has just returned to Russia on her tourist visa. We would both like to get married as soon asap. I know that it looks like we can be waiting for quite some time..... Basically we meet all the requirements that I have seen, we both have never been married, committed any crimes...etc Does anyone know if this will help expedite the process a bit faster or should we make plans for her to come back to stay with me on her tourist visa until we receive word of an interview. Any info would be greatly appreciated, thanks for taking the time to read.

The purpose of the K-1 visa is to get married within 90 days after the Beneficiary enters USA. So to answer your question.....not being married will not make the process go faster. It depends on many factors.

Start by reading the guides and looking at the examples at the top of the page. That will truly help you prepare the I-129F package as well as for the rest of the process.

March 9, 2010 - Received appointment for biometrics - will be on March 18

March 18, 2010 - Biometrics done

March 19, 2010 - Touches on I-485 and I-765

March 25, 2010 - Advance Parole approved..received on April 1 in the mail

March 29, 2010 - I-485 notice date, received on April 4, 2010

May 3, 2010 - EAD approved

May 5, 2010 - Date interview....approved

You can only apply for a K1 Fiance Visa if you are NOT married.

If she goes over there on a tourist visa, you can marry her and then file for AOS. But I wouldn't recommend that.

K-1 TIMELINE:

05-11-2009: NOA1

05-20-2009: called the Military Help Line and requested for expedite

06-04-2009: NOA2

06-14-2009: NVC letter received in the mail

07-02-2009: Packet 4 received

08-27-2009: Interview - Visa approved!

09-03-2009: visa in hands.

09-20-2009: POE - Miami

09-21-2009: we got married!

AOS TIMELINE:

05-12-2010: NOA1

06-08-2010: Case transferred to CSC

Hi,

Nothing about your case will make it go "faster" than any normal case. Of course problems in these areas will make it go "slower". Doesn't sound like you have any problems so jump in line with everyone else. You will not need to run around getting marriage, divorce and name change certificates translated from Russian, so it will save YOU that trouble, but no time in the process.

She can stay here until her interview, it is not a problem if she has a valid visa. be mindful NOT to overstay during this process.

I guess what I meant is that if we have no restrictions or past marriages will that speed up the processing time? I am aware that we will have to marry w/in 90 days of her entry into the US. But I looked at the estimated time line and it said that it takes about 6 months. We both do not want to be apart for that long. I have read and re-read the guides many times lol. I just was wondering if it was anything like when I received my passport, the govt told me to expect it in 3 months and i got it in three weeks. I understand that this process is much more complex then me registering for a passport but I was just wondering what most peoples estimated wait time has been (start to finish) From submitting the I-129F to issuance of the K-1 visa. Thank you for responding to my post I appreciate any and all help.

My friend.....nobody likes to be apart from the loved one for that long. But the process, apart from a few variations from country to country, is pretty much the same for everyone. There is nothing you can do to speed up the process but there's much you can do to prevent it from going slower. For example, try to avoid RFE's as much as possible. There is a thread on this very same section dedicated completely to list all possible RFE's.

Again....follow the guides....check the example forms....check the respective embassy reviews, you'll be able to read experiences from many others that have walked this road before you. And of course ask as many questions as you like. In short, be ready for anything and everything.

I understand what you mean, we were hoping the same thing. I think it helps in the fact there is less paperwork that can be lost/not included/forgotten/misunderstood etc. Like someone said you don't have to include divorce or death certs. However there is no "fast track" for easy cases. Each case gets put to the back of the line at each step and you just have to wait till you are at the front. I guess at the interview stage it could be easier since you don't have to worry about questions like "you've married 5 americans already, do you just want a greencard" but that is pretty much it. Good luck and sit tight, it's a long wait but well worth it.

No it will not. Any past marriages would have to be documented as terminated and that you are free to marry before you file the I-129f. Not having them to document may reduce YOUR preparation time, not documents to translate, etc., (we spent two months just getting everything ready to file, translated divorce certificate, etc.) but once it gets to USCIS it will follow the same route as any other petition.

6 months is a minimum for her to arrive, that would be fast. Remember the timelines you look at are for petition approval, from there you go to NVC and on to the consulate, this can take 3-8 weeks, depending if you get "additional processing" at NVC or not. Our case went very fast and it was about 6 months to the day until Alla arrived from when we filed. The time between approval of petition and interview took longer in our case than getting the petition approved (NOA2).

Yes, it is possible it can go faster, not because you were never married before, just the luck of the draw. What can you do to make it go faster?

1. Spend an extra day or two to make SURE everything is correct, it can save weeks in RFE-land.

2. Get all your documents ready for the interview now and get the translations you need so that when the petition is approved you will be ready to go to the interview as soon as the consulate has your petition.

3. Make SURE all those documents are complete and correct
