They start by filing the I-130 & 1-485. File them together at the same time.

They can file for the I-751, but won't want to use it.

WRONG. I-751 is for Removal of Conditions. NOT for adjustment of status.

Again, to the OP :guides:

Ok then, I thought they were refering to filing for AP. Seeing as the couple has been married for 2 year already, if approved they won't need to file I-751. Thanks for the nice bolded WRONG, I really appreciate that. Apparently they have read the guides and have further questions. I don't see that people asking questions does any harm. If we can waste space joking around and taking up a whole page of this thread with nonsense, then we can have some room to answer questions as well.

12/14/2006--- Mailed EAD App.

01/20/2007--- Biometrics

02/09/2005-------Sent in request to Congressional office for assistance with expediting EAD.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

He can adjust the status as long as he is married to USC Spouse.

It does not matter if he overstayed on his visa, once he has been married to USC Spouse,

he can file to adjust the status. The "overstaying" or you call it "staying illegally" is usually forgiven by USCIS.

He has to file I-130, I-485 and I-765 plus supporting documents concurrently. He does not have to file I-131 which is Advance Parole (AP), he can not use it anyway. Tell him to stay in USA until he receives his GC. Otherwise, he will be banned to enter the US for 10 years. Since they will have been married more than 2 years at the time of AOS application. Thus he will receive a permanent GC (10-year), not a conditional one.

The initial cost:

To file I-130 ................... $355

To file I-485 .................. $1,010

TOTAL =========== $1,365
