Visa Approved: 11/04/09

AOS approved: 04/21/10

ROC sent: 01/25/12

ROC received: 01/27/12 and signed

Of course you can marry him. I assume that your question is really can he stay and adjust status to Legal Permanent Resident? There can be some risks.

Many here on VJ are going through the same process. Read the guides here and make the decision for yourself. It is a very straight forward process.

We have friends on H1B visas that married here. I don't know what difference and HB-2 is from HB-1?

As long as the H visa wasn't acquired for the purpose of marrying - IE you meet and got engaged after he was already here legally, there shouldn't be a problem.

I don't know specifics for H2-B either, but I do know that H1-B's regularly adjust status to permanent even without marriage (I understand from many Indian friends there is only a time limitation under normal... eg. no marriage to USC or other extenuating factor .. circumstances), so, if H2-Bs have the same requirements, there should be no problem. And certainly no need for a K-1 visa!

In general, if there was no intent upon entry to the USA to adjust to permanent status, there usually is no restriction from marrying and petitioning for AOS for *most* visa types. The main exception I am aware of is a J-1 visa with a 2 year residency requirement.

01/15/2009 -- she arrives in USA

01/16/2009 -- proposed! she says YES!!! :)

02/14/2009 -- 6 days of bliss in Walt Disney World (6mo given on I94)

02/23/2009 -- sent I129F Next Day Air

02/25/2009 -- NOA1

03/01/2009 -- Touched

04/09/2009 -- She flies to USA for 9 day visit (6mo given on I94)

06/20/2009 -- She arrives for summer visit (6mo given on I94, warned about too frequent visits)

06/30/2009 -- NOA2

Note: petition processed thru NVC and sent to embassy in about 1 week :o

Note: got an initial interview date in Sept, but decided to put it off so she could extend her vacation here thru end of October

10/21/2009 -- She returns to Poland :(

12/01/2009 -- Embassy interview -- SUCCESS!! :)
