Hello guys,

I am in f-1 status right now. Before i had j-1 with 2 year residency, but i need to get waived before i adjust my status to permanent residency. But, I was told that i can that I-130 and get approved do the AOS later. My question is: Can i send I-130 with EAD form to get the work permit?

no, because the I-130 does not provide a basis for work... it is the I-485 that does.

no, because the I-130 does not provide a basis for work... it is the I-485 that does.

I agree. But OP, you say you're in F-1, are you eligible for OPT? And What's the basis for your I-130/AOS petition?
