on 6-2009 februaryi got a denial decision notice for my case I129F PETITION FOR FIANCE(E ..because my fiance sent the additional evidence to unvalid address ..my lawyer told me that we should reopen the case

she appealed on 17 february

i check my state onlin but i find the same thing ..i mean the message has not updated yet ...so my question is when the uscis updat the mesage on the site and what it should be ...thanks in advance

please i need help coz i am so worried coz i am so far from my sweetheart

When you reopened the case, you resent your petition with a valid address, right? So they sent you a NOA1 and now you check your case online and it still says your case is denied? Is that what is going on?

When you reopened the case, you resent your petition with a valid address, right? So they sent you a NOA1 and now you check your case online and it still says your case is denied? Is that what is going on?

It looks more like they sent in the petition then were asked for additional evidence RFE and they sent that to the wrong address. But just my guess....

CSC is not updating their system for our cases. Many March filers and even Feb. filers were approved, but no update with their case with USCIS On line case status, it shows their cases are still pending, even with the NOA 2 in their hands.

So dont go by their system full heartly.

yes it still says my case is denied when i check it onlin ...

my lawyer told my that they got my PETITION on 19 marsh ..then she said they are working on it but i do not know if that is my NOA2 ..is it ????

the lawyer told my that the proceing time processing time for cases is 45 days then i get approval

from 19 marsh to 7 may more than 45 days .....i have not got any thing yet from immegration

• What we on VJ call a NOA2 would be your approval notice (NOA = Notice of Action on a form called I-797c) so I doubt you received your NOA2.
• Processing times are a bit longer than what your lawyer indicated - it is currently more like 120+ days (not 45).

You need to talk with your fiancé - since only the US Citizen (at this point) will be getting any communications from USCIS. It's difficult to say what exactly is going on; based on what you've described so far - all we can tell is your original petition was denied (for unknown reasons) and it sounds like a petition was either re-submitted or re-opened in March.
