Me and my fiance applied in may of 2008 and it has been well over 6 months like they said at vermont immagration we have waited 11 months for an answer and this month they went to may 12th and then they just put 6 months what does this mean? we just got a letter saying they are reviewing our file now they said but they also said it would be maybe 60 days more for an answer i guess but who knows really cos I called them on the phone and they told me it could take up to another 2-6 months at that this is crazy can someone help us to exactly know what this means and how long from the time of the review it will be befor an answer comes ty

If they said they are reviewing it now. That is a good sign. Did they say it was assigned to an officer, or just that they are "reviewing it"? The wording is important actually.

They usually have a few different answers depending on where you case is in the process:

"pending" <--means its sitting somewhere and no one has touched it.

"In the work que" <--It's getting ready to be assigned to an officer for review

"with an officer" or "being reviewed/adjudicated by an officer"<--your case is actually being worked and adjudicated for approval or RFE.

If your case is indeed with an officer now, you should get an answer within a few weeks.

Since you guys have been waiting so very long, I would definately write/call your local congressman and ask for a "formal detailed inquiry". They usually give the congressman more detailed answers than they give us, maybe that is how you got this answer?

I dont think you are in Administrative Review or anything because they probably wouldnt have given you a timeframe. With AR and AP they usually say "unknown"

I cant really tell from what you have said exactly where in the process you are - is it still in Vermont and you dont have the NOA2 approval yet?

well whatever it is, now is probably a good time to get your senator involved. You can find and contact your senator and/or representative online (although you will need to fax over an authorization) and have them make an official inquiry.

thank you for responding to mine and my fiances questions but i do think we are in the adjudicated stage and that means maybe within the 60 days they will finally give us an answer when i put it on timeline it automatically gave me that answer so i am praying to allah that he will bless me and my fiance to be together once and for all if you have more info for us please let us know and you both have such a beautiful baby God bless you Yahya and Marie

Hopefully it is with an adjudicator and thats what they mean by "in reveiw". If thats the case, it will be WAY less than 60 days. :) They have a canned answer for everything for every step of this process "30 days" "60 days" and so on. :rolleyes: But its best to just look at others experiences, and once people get news that it is with an officer, its usually just a matter of weeks.

Without knowing all the details or knowing exactly what your letter says, i can only speculate

Well, once you put in an inquiry, the service center will typically send a letter a few weeks later with a response. From what you have said, it seems you put in an inquiry request last time you called and they sent you a letter saying that they have asked someone to review the case. This MAY mean, they are reveiwing(researching) the REASON why its still under process OR an officer is actually reviewing your files.

Here is what I would do if I was in your shoes....

find out who your congressman is

get the contact info.. if they have a fax #, this is easier

fill out a privacy release form(usually available on their website)

write a short letter asking them to do a DETAILED formal inquiry into the status of the case.

follow up with a phone call if you dont get a response within a week.

The congressmen have a liason at the service centers that they can contact, they get more detailed and up to date information than you or I get when we call.

They will need your receipt #'s, your contact info and the privacy release form.

which application is better to file for the co-sponsor the I134 or the I864 and should we wait til after we file or should we do it now when we file again the I 129f petition

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Why are you filing another K-1 petition?
cos when i got the congressman to call there they said they did send me something to send it back in and they never did cos i faxed it the first time but they say they never got it so there for without getting a letter to do so i thought they had everything and now until they got a call from the congressman i just got the letter today just a few min. ago they said they sent me a letter stating that i had til dec. to send it in to reopen the case and it would cost 585.00 but like i said i never got that in anycase i will have to another petition for my fiance again and that is it they said
