Different Timelines For I-130??

Is the I-130 the most diverse of all applications or what? I have read so many different posts that refer to parents, sons, daughters etc etc, but there seems to be a different timeline for what relation you are trying to bring over. In my case I will be trying to bring my 13 year old son over to live with me, but have no idea what to tell him as to how long it will take. I recognize that once the son or daughter passes the 21 year old mark, their wait time grows considerably, but what about younger kids? What can I advise my son as to how long he will have to wait? I've read 6-9 months but is that just for granting of the visa and he has another wait for one to become available?

Having gone through the relatively straight forward K1 process, this seems to be an absolute nightmare. My son seems so desperate to join me and the last thing I want to do is dampen that enthusiasm with negativity.

Is your spouse a US citizen? If yes, then your spouse can petition for your son as his step-son in the Immediate Relative category. He should be able to get a visa within a year. Your spouse would need to file a I-130 for your son.

The other route may be that your son may be able to "follow" on your K1 if he was listed. I don't know much about this so you can ask others on this board.

Many thanks, I had an idea that my wife might be better placed to file. As for the K1 I have already identified through another post that the 'follow on' is only valid within the first year of receiving the K1, which has long since past.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

• There is no waiting list to immigrate these relatives.

immigrant visa as soon as we approve your I-130 petition.

• If your petition has been approved, and your relatives are

currently in the United States after making a legal entry (and

they meet certain other requirements), they may be able to file

applications with USCIS to adjust to permanent resident status.

Im with you on this one! My USC husband applied for my 17 year old , last month , no updates , and he is desperate and miserable , i just wish there was something i could do ,, if i find out any info , i will let you know!

When did you submit your application?

I did read on USCIS website 5mnths.
