It was filed on the 3/31/09 they sent me a email stating they have it in hand on 4/4/09.So how long is this going to take for it to be approved?? I see the time line is 4 to 6 months??She has a son who is 2 years old so does this slow things up any??I own a Business and I see that I have to file a I 134 affidavit of support.I called my Lawyer and ask if we needed to do that now he told me I did not.That he would do that after they have sent him a email saying we are Approved?So do I get this puppy put together and ready now or wait?

The thing is I show big gross sales in my business but not much net,So will they look at my net or my gross for my company.I make real good money but I have a shop and I have big over head.I still make good money but last year was a hit for me.I lost about 75,000.I went from 235,000 to 160,000.Plus I took over another business the drove my over head even higher.I still did good even with the economy taking a bad turn.The only thing is I owe some back taxes and I have worked this out with the IRS and Im in no trouble.

I guess what Im asking he how long will this take to get her to Kiev for the interview?

And does it mater what my Net is to my gross?

And do they look at IRS back taxes?

Most business have problems with the Tax man this days,With economy not doing all that great.They seem to focus more on us small guys then the big ones.

And any pit falls I need to look for.

Oh did I say i miss my girl so bad and I love her more then any thing.God when you meet you soul mate there really is nothing you can do about it.

You present the I-134 at the interview in Ukraine. You do not send any documents to the consulate, your fiancee will bring them with her. Her son will make no difference in timing of the process.

They consider only the income you claim on your personal 1040. Not the gross sales of the company. It is the "net" from schedule C. Look at the 125% poverty guidelines for the I-864. I believe it is about $22,000 GROSS persoanl income (not business) for the guideline. They do not care about back taxes if you have a payment plan in place. If you have tax leins it can be a problem.

Let me clarify. They filed a lien, and then I set up the payment plan. This was June of last year.

Okay I need to make sure I have a payment plan in place before it goes to Kiav? Also do they factor in the last 3 years of income?? I can chang this past year because I filed for a extension,I can get them to not take as much out,put my truck and a few trips I took out of there and that would incress my income.Or should I play it safe and just get my mother and father to cosponsor for me.They have plenty of land and they dont owe any thing th IRS.2 house on there land and one of those is Mine.

You do not need three years of tax returns for Kiev. One will be sufficient, 2008. I was self employed in 2007 and prior years. I knew I would be going to the interview in 2008 when I did my 2007 taxes and made sure my bottom line was adequate by foregoing as many legitimate deductions as needed (and paying more tax than necessary, of course). I also presented at the interview a bank letter listing my previous 12 months deposits in my personal account. This was actually more than my claimed income on line 22 of the 2007/1040. No questions were asked. If presenting 3 years tax returns is not to your advantage, do not do it. If those returns show higher income than 2008, it is your choice. Kiev is more concerned with current income and verification of that. In the case of self-employed they have to look at the previous year and bank deposits. You may also include, if you do this, copies of checks or check stubs the business writes to your self.

I would suggest you present as documentation....

I-134 stating current income, 2008 tax return showing income in excess of guidelines, letter from bank or copies of previous 12 months bank statements. I prefer a letter from the bank which states when you opened the account, the amount of deposits for the previous 12 months (as close as possible to the interview date) and the current balance. I would provide as "back-up" a P&L statement for each quarter to date for this year. Your interview will likely take place the last quarter of this year, possibly 3rd quarter.

If everything is above the guidelines, you do not need to mention assets, leave all that blank. And yes, be sure you have everything in order with the IRS in terms of back taxes, before that time.
