Im writing this in behalf of my friends. She got her interview but sadly they need further papers to support the application since her fiance didn't work for the last couple of years due to medical condition. They used the guy's father as a guarantor and was asked to submit his tax papers and properties as well. During the embassy's review, they said that the guarantor didn't make enough money which is not true because he's got a lot of properties and his bank account says he's got a lot of money. The process was so complicated and we need some input from you guys.

What should they do? Any input regarding this topic is very much appreciated. Thank you.

They have very strict guidlines for the poverty level and if he cant meet the set amount they wont allow her a visa.

This is to protect the tax payers from having to support her when she comes to the u.s.

What i cant understand is i see so many people saying they dont qualify for the poverty level, how do they expect to support a spouse and family when they get married and try to have a family together.

I would think that before someone decides to take on the responsability of starting a family they would first get a job that is able to support a family of 2 or more.

I am not sure what you can do to help your friend with their problem except maybe get another cosponser that makes enough money to surpass the poverty level for the appropriate size family.

Another thing is that when it comes time for the aos (adjustment of status) the level goes to 125% of the poverty level.

I just did a search and got this link for you , its the 2006 poverty guidlines that the govt. uses to determine eligability for visa.

Your friend will need to meet the 100% for the visa and then they will have to meet the 125% range for the AOS (adjustment of status ).

Hope everything works out for your friend, that would really suck to have gone through all the hoops and then get denied right at the last part of the process.

Sorry i stand to be corrected on my past post's.

I looked at the guidlines and see that the 100% is for active duty military and the 125% is for all other petitioners.

So your friend unless he is active duty military will need to prove he can meet the 125% range for the appropriate size household that lives at the address of the sponsor or cosponor.

Then he needs to fill out the I-134 form correctly to reflect his financial position.

I thought they didnt allow co-sponsers in the PI's.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

You do not use the 864 in a fiancee visa.

AIT in Taiwan requests the 864 eventhough technically it doesn't go into affect until sometime later this month or next month .. weird.. its crazy how each embassy has different rules and regs.. crazyyyyyy

Your right Vartan every embassy or consulate is different that is why I sent them to the US embassy in Manila site as that specifically tells them the rules for their K-1 visa.

Yes they accept co-sponsors for the I-864 (as per the Embassy link), however evidence from those applying for a K visa in the Philipines have not been able in many cases (if not all) to use a co-sponsor with the I-134.

I'm confused now...

So I can use the I-864 Affidavit of Support for Fiance (K-1) visa?

or,

Must it be the I-134 Affidavit of Support?

What's the difference?

For K-1 you use the I-134 and present it during the interview. The I-864 is used together with the Adjustment of Status (AOS) after marriage in the US.

The AIT web site links to a generic USDoS web page for information about marriage-based visas. The USCIS web page for marriage-based visas specifies that the I-134 affidavit of support may be requested for the K visas.

I find nothing on the AIT web site that is AIT-specific and contradicts this.
