Hello all,

My husband and I just applied for the I-751 at the VSC. The package was sent 4/02, received 4/06. No checks cashed or notices at this time. I'm just wondering: we moved from Virginia to New York in Oct. of 07 after he received his first greencard. We didn't file any sort of change of address with USCIS but we did with the postal service and all of our I-751 paperwork reflects our current address. Will this present any sort of issue in terms of our receiving notices?

K1 Journey:

2/07/06 I-129F sent

2/13/06 NOA1

2/28/06 NOA2

5/12/06 Boris's interview in Moscow

5/19/06 Visa in hand!

5/22/06 Boris arrives in Washington D.C.

8/06/06 MARRIED!!!

AOS Journey:

11/28/06 AOS, AP, and EAD mailed

12/04/06 NOA1 for all applications

12/07/06 All applications touched

12/09/06 Biometrics appointment letter received

12/11/06 All applications touched

12/13/06 EAD & AP touched

12/15/06 Biometrics in Norfolk, VA (very simple, took 30 min.)

2/01/07 FBI info line confirms biometrics were received and returned 12/15

2/07/07 EAD and AP touched, AP approved

2/08/07 EAD and AP touched

2/12/07 EAD approved; card production ordered

2/12/07 Interview notice received

2/13/07 EAD touched

2/16/07 EAD received

2/17/07 AP received

4/30/07 AOS Interview--APPROVED!

5/07/07 Welcome notice received

4/02/09 I-751 sent to VSC

4/06/09 Package received @ VSC

By law, you are required to inform USCIS every time you move for as long as you are a permanent resident, You have 10 days after each move to do so. What the penalties are for not doing that I don't know; but be prepared for a long winded process. They have your old address on file, so it would not surprise me if your NOAs or RFEs were undeliverable.

Penalties for Failure to Comply

A willful failure to give written notice to the USCIS of a change of address within 10 days of the change is a misdemeanor crime. If convicted, the alien (or parent or legal guardian of an alien under age 14 who is required to give notice) can be fined up to $200 or imprisoned up to 30 days, or both. The alien may also be subject to removal from the United States. (INA § 266(B)). Compliance with the requirement to notify the USCIS of any address changes is also a condition of an alien’s stay in the United States. Failure to comply could also jeopardize the alien’s ability to obtain a future visa or other immigration benefit.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I would file the online Ar-11 and the I-865 (which you have to mail in) now

but I don't think the fact that you didn't do the change of address will affect your petition because you put your new address on the forms...

sometimes it just takes awhile to get the notices etc.. and you have been only waiting a few weeks..

Please use the link Bobby_Umit posted above for the detail info about change of address and why do you need it. You can do your change of address online for the applicant.

You also need to do the change of address for the sponsor (the citizen spouse).

If you don't do this they will send info at your old address and you have violated the law.

Thanks for the responses. I called USCIS and they told me that actually all notices will be sent to the address given in the I-751 package, NOT our old address, thank God! I had changed our address with USCIS online right before I called them anyway so all is well! The woman I spoke to didn't say anything about any penalties and didn't even make it seem like a big deal. In any event, they have our correct address now.

Welcome to the April 09/VSC filers club. We mailed our I-751 package around the same time, we have no address change issue, but still waiting for the check to clear, NOA1 cannot be expected before check clears. We have to patiently wait.

I-751 process:

4/06/09: Mailed I-751 to VSC by Express mail

4/07/09: Received by VSC

4/17/09: Check clearance.

4/20/09: NOA1 received in mail (receipt date: 4/08/09)

4/30/09: Biometric appt. letter received (appt. on May 15th)

5/05/09: Walk-in biometric done

9/02/09: Approval Email (touch on USCUS site)

9/03/09: Approval letter received (decision date: 8/27/09)

9/09/09: Touch, but no change in status on USCIS site.

9/11/09: Green card rec'd.
