hey, can anyone help? i'm pregnant and my fiancee is filing a petition for fiancee visa for me. my concern is- how can we petition for the baby, as he/she is still unborn? can we file the supplemental visa for the baby after his/her birth? and does this mean that my visa will be approved first then we have to wait for the baby's visa before we can fly together to the u.s.?

i really appreciate any help i can get!

If the baby is born to a US citizen abroad, then a CRBA needs to be filed so the birth is registered. If the baby has a USC parent who meets the residency requirements, the child is automatically a UCS.

Some embassys require a DNA test to prove the baby is the child of a UCS.

Through birth abroad to one United States citizen

For persons born on or after November 14, 1986, a person is a U.S. citizen if all of the following are true:[4]

One of the person's parents was a U.S. citizen when the person in question was born;

The citizen parent lived at least 5 years in the United States before his or her child's birth;

A minimum of 2 of these 5 years in the United States were after the citizen parent's 14th birthday.

INA 301(g) makes additional provisions to satisfy the physical-presence requirements for periods citizens spent abroad in “honorable service in the Armed Forces of the United States, or periods of employment with the United States Government or with an international organization”. Additionally citizens who spent time living abroad as the “dependent unmarried son or daughter and a member of the household of a person” in any of the previously mentioned organizations can also be counted

If the USC is the father of the baby and it is born before you come, it will need a U.S. passport rather than a visa in most cases.

The birth of a child abroad to a U.S. citizen parent(s) should be reported as soon as possible to the nearest U.S. embassy or consulate to establish an official record of the child's claim to U.S. citizenship at birth. The official record is a Consular Report of Birth of a Citizen of the United States of America, or Form FS-240. This document, known as the Consular Report of Birth Abroad, is a basic United States citizenship document. An original FS-240 is furnished to the parents at the time the registration is approved. A Consular Report of Birth can be prepared only at a U.S. embassy or consulate. It cannot be prepared if the child has been brought back into the United States (although a different document may be requested - see the next two paragraphs), or, if the child is 18 years of age or older at the time the application is made.
