Please help.Need some advice

My husband will file the AOS by next week. I arrived here March 31st. I dont have an SSN yet so is it good to file married separately and then ammend it later when I have my SSN? Do I have to send along with my AOS ,the I-693 form of the civil surgeon in my area? I haven't taken any vaccinations yet.

I presume you mean income tax? Were you arried prior to arriving? K-3? Were you amrried prior to the end of 2008? If yes, he can file "married filing jointly" and for your SSN write "pending" . He will NOT be able to file taxes electronically without you having an SSN. Fill out the forms, sign them and mail them to the IRS, use one of those stamp things on an envelope, just like we used to all the time. You do not have to file an amended return later.

If you arrived K-1 and were not married before the end of 2008 he cannot file "married" for 2008

Since you are married in 2008, just mail your return as "Married, Filing Jointly" & explain that you do not have

a SS# yet on a piece of paper. By this way, you guys can not get some credits like the most important one, EIC.

If you file electronically, the software won't let you leave the SSN field blank; it won't accept it without one. You will probably be forced to send out a paper return.

File a W7 for a ITIN for you and file jointly. USCIS likes it and you guys won't have to amend later.
