I'm wrote a letter to cancel the I-129F process (My fiancees visa was denied and we're getting married).

In the letter I've included the reasons why I want to cancel the petition. The reciept number and the type of petition. Is there anything else I need to include in this letter?

K-1 Timeline

I-129F Sent - 3/4/2008

I-129F Recieved - 3/5/2008

I-129F Approved - 5/7/2008

Interview Date - 8/26/2008 - (Asked for petitioner to be interviewed as well, new interview Date 9/18/2008)

Interview 2 Date - 9/18/2008 - (Case Sent to review, and not DENIED as I orignally thought)

Gave up on K1 process - 9/19/2008

Canceled K-1 Petition - 5/1/09

Married - 5/30/2009

Recieved K-1 2nd Approval (HA!) - 6/6/2009

Be sure and have the letter notarized!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

But if its already denied, it shouldn' be valid anymore. Or are you talking about a regular tourist visa that was denied?.

11/1999 - We met in Ecuador

02/05/00 - Relationship started

09/08/06 - Engaged & Pregnant!

03/13/08 - I filed for Citizenship

07/22/08 - Became US Citizen

08/02/08 - I-129F sent

08/13/08 - Case received by VSC

08/16/08 - NOA1

08/18/08 - Touched

12/18/08 - Touched again exactly 4 mos. after 1st touch!

12/18/08 - Noa2 @ 3PM-Gracias Dios Mio!

12/24/08 - NVC sent pckg. 3 to Embassy

01/02/09 - Pckg 3 rcvd. by Embassy

01/09/09 - Pckg 3 from Embassy received by beneficiary

02/09/09 - Medical exam

02/16/09 - Sent back checklist and docs required by embassy.

03/13/09 - We will fly to see Daddy Gary

03/16/09 - 1 PM Interview (Pray God he gets visa)

03/16/09 - 5PM INTERVIEW PASSED WOOHOO. Thank God.

03/25/09 - Visa on hand! he went to DHL office after phone call received.

04/18/09 - My Cuchi came, (NYC)a wonderful unbelievable moment!:)

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

I filed for the I-129F visa. We were denied at the interview. Our case is under review at the USCIS. I just want to cancel it to avoid any future problems.

The actual advice is no NOT cancel it. SOmehow if you cancel it the systems takes the consulates opinion as fact and if you just let it sit then it is still in review. You address whatever their beef was in your next petition.

I've heard that before as well Haole.

However, what I think the OP should weigh right now is that marrying his fiancee does not in any way guarantee a visa.

To the OP: what if any instructions did you receive at the interview?

Haole - many of us with returned petitions have had more than one attorney state that if you plan to go forward with your lives together and at a later date will still pursue a visa do NOT cancel the returned petition. It can be seen as a de facto agreement that the CO's conclusions/reccomendations were correct and that if you try to refile you can get slapped with a misrepresentation...

Additionally, to any K1 filer with a returned petition, DOS has a memo from last May stating that the service centers should expire denied K1 cases. There shouldn't be anything to cancel.

To the OP - if you are going forward with your relationship and want some info on what you can try to do, who to contact, etc...there is a sticky thread in MENA about returned petitions. Many people there have been dealing with a 221g denial - not sure if you're in the same boat. If the denial can be resolved with a waiver [should be on the paperwork], there is a forum here that deals with that too with some really great helpful people.

My heart goes out to you, having a denial is absolutely heart wrenching... (F)

Ok, I've heard of a case where a couple was denied their K-1 visa, and then when they went through with a marriage and tried to get the K-3, somehow the beneficiary was banned from entering the United States. This is why I'm worried, and why I want to make sure this doesn't happen to me once I go through the K-3 route.

I recieved a sheet with Dection 212(a)(5)(A) highlighted. It says we didn't provide enough evidence.

This was our second interview, in which I had to get interviewed.

Just talked with a lawyer, and he told me to send the letter. Ha! this is like millionaire, when you use up all your lifelines and you still have no clue what the answer is.

What does your fiancee do? I don't get how it applies to a relationship based visa. Has she been to the US and overstayed a work visa?

Read that - it's scary as all get out - I know.

Also get in touch with your senators/congress person to get a real feel for what went on with your case. Right now holding steady to figure out what is happening/had happened is probably in your best interest. A couple weeks to figure out a strategy may save you a lot of heartache down the road...
