Timeline

Hi guys: I filed my i485 application based on marriage to US citizen in june 2005. My first interview was done in November 2008 and second on January 9 2009. I called today in the customer services and they told me that the application is on hold in the review department in atlanta office. It could be take another week or 60 more days. Can any one please tell me what is review department and how they works. My name check and background checks all are completed. I came on H1B visa in 2002 and marriage with a US citizen in April 2004.

There might be a couple of reasons, but you have to tell me first "Why did you guys have to go for the 2nd interview" ? What happened at the first interview ? If you kindly explain your situation in a specific way,

I will be more helpful & able to answer your questions more accurately.

Married: June 9, 2008.
Visa expired : June 12, 2008
Filed for AOS . Sent through USPS Priority Express : March 03, 2009
Package Delieverd at USCIS: March 05, 2009
March 13, 2009 : Checks Cashed
March 13, 2009 : NOA 1 received on I-485, I-130, I-765. Dated March 11th, 09
March 17, 2009 : Biometrics Letter recieved (Dated 13th March). Interview on 1st week of April
April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.
July 31st : Received conditional green card
Removing Condition
3/25/11 - Received reminder from USCIS to file for ROC
5/6/11 - Sent I-751 Packet to CSC via usps
5/9/11- Package delivered to csc.
5/11/11- Check cashed electronically by CSC
5/16/11- NOA 1 received

INTERVIEW DETAILS

I was called for my first interview on November 23rd 2008 after close to

four years wait. I married in NY in February 2005 with a American citizen

and moved to Alabama in 2007. I came on H1B visa in 2002. My H1B was

expired in August 2005 but I married before it expired. Ok since I moved

from one state to another I don’t have a lot of documents during first

interview in Atlanta. I have joint tax returns, my job letter some mails

and my wife school information in NY, as she is still a student in a

school in Alabama. He kept the I-95 from my passport in first interview.

After first interview he said that we don’t have enough evidence but he

didn’t said any thing about his decision. He called us for the second

interview on January 9 2009 at 8:00 AM again in Atlanta. Ok this time he

asked separate questions first from my wife and then from me.

How and when you met me first time

How many main doors are in your trailer

How many locks are in your trailer

Who cook the food

Where you wash the cloths

Have you and him ever go to church

What are the name of your brother children’s

What movie I like

What I did on January 8th

What did you cook on Christmas day

What your husband buy gift on Christmas day

What is the name of your school is

What you are studying

Have your husband ever lie to you

Where your husband sleep

On which side he sleep

Where your husband works

How much he makes

Where we married

Question 2 I told the different date compare to the date which my wife

told to him and question 9 I told the name of the movie, which was

different from my wife answer. Q 19 has a dollar difference between her

answer and mine. Rests of all questions have same answers.

He check my passport again and asked me what was my occupation when I

entered into the united states and I told him that I am a computer

programmer. The new evidence, which I showed to him, was the joint bank

statement of March, April 2006, as he wants the old stuff. He kept the

statements my job letter evidence of my wife shows about her admission in

the school in NY, pay stub of the place where she works in NY and other

stuff, which are the mails in NY and Alabama and the pictures of thanks

giving in which I am with the whole family include my father in law, my

brother in law and his kids. Also he asked me about the lease I dont have

any lease as I have a trailer which is parked on my fater in law property

and he dont charge any money from me. He told us in the beginning that he

will not tell the decision. I will get the decision in mail within 2

weeks or if I don’t receive the decision within 2 weeks than wait for the

6 months and then come to the uscis office and ask for the status of your

application.

I think you really missed an opportunity at the first (as well as the second) interview. Since you were married for nearly four years, you should have brought tons of evidence of living together and commingling of finances at the AOS interviews. Lack of evidence, after so many years of cohabiting, is in itself a red flag. Also, different ethnicities (my assumption) may also have contributed to extra scrutiny.

“Background check” is a delay tactic that USCIS uses excessively. The USCIS often delays cases with so called “red flags” to see if the marriage stays put for an extended duration. But if your relationship is for real, you will eventually get it.

Make an infopass and take your wife with you and let her talk to the officer. I personally believe that it does make a difference when the petitioner shows some interest as well.

I dont want to go their. Its 5 hour drive as the office is in atlanta and i live in alabama. Can you please tell me what they can do else as I have been married since over 4 years and a very happy life. I think may be only thing they can do is to hold my file for few more years I am not worried about it as long as i get the new EAD.

Since you were married for nearly four years, you should have brought tons of evidence of living together and commingling of finances at the AOS interviews. That is really awkard !.... Anyway..

Forget about the past, let's concentrate on your current situation.

You can do service request about your AOS application

by calling NBC (USCIS Headquarter in Missouri) to ask about your interview & why it's been taking so long.

See what they say.

Timeline

Latest is the application is on hold by the judicator. I asked to the customer serivces that how long the judicator takes time to make decession and she said she dont know. I just want to know after 4 years if they deny my application then what i do after it ? Can they send me to the immigration court ? I can go with my wife their too.
