My wife and I are well along on the process to getting her a K-3 Visa to the US. We’re waiting for her appointment date at the consulate, and sent in the DS-230 Part 1. I think everything’s been going smoothly so far, and we’ve been closely following the advice of these forums. But at this point I think we have a few important questions and concerns:

1. I’ve been living overseas with my wife for the past year or so. We wanted to be together and I wanted to explore abroad a bit, so I moved to Viet Nam. However, now I’m concerned about the AOS form I-134. I got a job here as a teacher, but I’m not sure it pays enough money – it’s right at the limit as described on the I-134p. My concerns with this are:

a. Do they accept paystubs and records from foreign companies?

b. Can I have another person, such as one of my parents, be the sponsor?

c. Can there be co-sponsors?

2. We filed first the I-130, then the I-129f to attach to it after we received confirmation. However, it looks like we now have two separate case numbers at the NVC – one for the K-3 and one for the CR-1.

a. Is that normal?

b. Which case number should we put on any documents we submit?

3. We tried to submit the DS-3032 via e-mail, but the NVC replied we should send it to the embassy, and the embassy said something confusing about the two different case numbers. We still haven’t received confirmation that they’ve accepted it, and it’s been about three weeks.

a. Does this delay our appointment date at the embassy at all? Are they waiting on this form to schedule one?

b. Does e-mail really work, or should it be sent another way?

4. The police records are done by province, and seem difficult to get. We’re going to get one from each of the provinces she’s lived in (three), but it’s still confusing.

a. How comprehensive does the police certificate need to be?

b. Does it need to be from a national authority?

I’m most concerned about the AOS clearance and the two case numbers. What do you all think? Any clarity here? Given all of this, should we get an attorney to guide us?

Any clear help or guidance you could provide would be GREATLY appreciated.

2. a. Yes since you have two petitions you have two case numbers

b. Case number will depend on which visa petition you are submitting documents for

DS 3032 is for immigrant visas... if you are going K-3 then this form is not used...

HCMC typically does not allow co sponsors for the K visas.

The CR1 utilized the I-864 which does provide for joint/co/additional sponsors.

Also, if your income will not continue in the US, you cannot demonstrate how you would support your wife. A US domiciled sponsor will be needed.

Check with the consulate regardng the 864 and cosponsors

Police certificates come from the provincial authority. See the Asia: East and Pacific regional forum for a recent thread about police certificates for HCMC.

The police certificate needed is called a Ly Lich Tu Phap. This is the only document that will be accepted for this purpose. She will need to apply for this at the Justice office in the province where she is listed in a Ho Khau. She can only be in one Ho Khau at any time, as you know. Therefore, the Ly Lich Tu Phap must come from the province governing the town or village where the household in which she is currently listed is located.

This process takes up to 3 weeks in many provinces. Some Cong An are not helpful so she may need to be persistent. Good luck.

I just wanted to mention that you are all very good, helpful people and I appreciate your assistance. Keep the suggestions coming! My wife is understandably nervous about things so at least we know a few things are on track. If we can get my parents to sponsor for the AOS that would be great. Hopefully the police checks will go through. We have a friend in the notary office which helps, but the government is so confusing it's frustrating....
