Timeline
The saga ends with a denial.

After the "white paper," we've been working to get all the paperwork just right, waiting since September. Today my wife went to resubmit. They interviewed her and asked why I haven't come back since our wedding on Christmas of 2005. (I had been in graduate school, broke, had to get a job and then worked and had to vacation time to leave for Vietnam.)

We had every piece of paper you could imagine.

Anyway, they are sending the case back to the U.S. :dance:

It's been such a long road and we are beyond the point of sadness or sorrow, so it's not really an emotional thing anymore. It's now a lifestyle for us.

We'll figure a way to try again and start from the beginning.

Good luck to all of you who are on this torturous journey. I hope your luck is better than ours.

First, it was my fault. I believed in all the rules and requirements on application forms/official websites. That's just not what they want -maybe 10% of what they want.

Second, I believed in the system, thinking that if you ARE legit things will work out. We never planned our life around the sponsorship process. We were oblivious to all the documentations, etc. Of course, I kept good records, etc., but I never made it a priority, and the same with my wife.

Third, when we switched from writing letters to talking on MSN and Yahoo!, that really hurt us because they do not count these as officially recognizable forms of evidence, including phone records. We have tons of records but they still asked for letters. I got very busy while in grad school and working full time that I had no time for letters. And how was I supposed to spend thousands of dollars to a visit when I'm trying to keep everything afloat financially for both of us (we submitted all the bank statements and wire transfers, too). All we had was the every day chats. Of course, I explained all of this in my notarized timeline. I had official school transcripts, everything. I even included my tips book from when I delivered pizzas.

Lastly, they used our long relationship against us (they interviewed her the second time when my wife went to resubmit), asking how can anybody carry on a legitimate relationship like we did, with just chats? They defined our relationship by THEIR standards.

How do you pass? Make your case look like a storybook relationship and go out of your way to document everything. These people are just making a judgment call based on maybe ten minutes of looking at everything. They read nothing and they certainly do not take any other factors into account beyond what they think should be "evidence" in their eyes.

It's a bogus system, but what are you going to do?

Wedding in Vietnam: 12/25/2005 (graduate school, below poverty line, couldn't apply)
[b]August 27, 2007[/b]: 1st I-130 packet sent w/incorrect $190 instead of new $355 fee (Mesquite, Texas).
October 6, 2007: 2nd I-130 packet with $355 fee (Mesquite, Texas).
January 10, 2008: NOA1 March 31, 2008: NOA2 (approved & sent to NVC)
April 14, 2008: NVC sent AOS Fee Bill (Affidavit of Support) $70.00 & DS-3032 form
Received.
April 15, 2008: Faxed wife the DS-3032 agent form to be mailed from Vietnam.
May 5, 2008: NVC sent request for Affidavit of Support form. May 19. 2008: received NVC's request for Affidavit of Support form.
May 20, 2008: Sent off I-864, Affidavit of Support May 30, 2008: Received IV Fee bill for $400 --money order & sent by Priority Mail.
June 10, 2008: I-864 approved. June 11, 2008: IV fee entered in system. June 16, 2008: DS-230 barcode issued
June 30, 2008: DS-230 mailed by expressed mail July 3, 2008: DS-230 package arrived at NVC & under review
July 11, 2008: Case completed at NVC.
Sept. 5th, 2008: INTERVIEW DATE at HCMC: White paper with writing.
March 26, 2009: Resubmit.
[b]DENIED. June 2009: case sent back & received at USCIS[/b]
August 2009: filed new I-130. Approved after first I-130 case sent to VN, again.
February 2010: USCIS contacted & asked for more evidence
March 2010: USCIS re-approved original case.
April 14, 2010: Consulate sends DS-230
June 15, 2010: Interview Date (Blue issued)
July 13, 2010 Placed on AP -yippee!
Sept. 13, 2010 Consulate home visit
[b]Nov. 5, 2010 Approval letter sent.[/b]
[b]Nov. 19, 2010 Visa picked up. Arrival: Nov. 24, 2010[/b]

Going that long without visiting your wife is a huge red flag to them also not showing up for the interview is another red flag. No matter if you had the money or not they don't look at that. I know of only a few exceptions

1. If she was pregnant and had a kid from you then it wouldn't matter you could easily get the visa

2. Getting a good interviewer. They have a few interviewers that are very easy to pass. If you get one of those interviewers you have a very good chance no matter how many red flags you have.

3. You and your wife share a common language and she get everything in the interview correct

My case is very legit and straight forward I didn't have allot of red flags like most people do. I have never been married and we are both the same age. The red flags I had against me is that her brother helped set her up with me she is not fluent in english and I only made 1 trip. I believed if I would have made another trip she would be here with me now

Understand 2 2 2 but I only had the chats to send in. I sent no emails or letters my self as we had none. We did everything by yahoo chats and calls through Yahoo. They accepted ours. I was not in Vietnam for the interview. I went only once there and got engaged at that time.

What I am trying to say is I am wanting to see why they denied you. It seems from what you said that you did everything right. Did the interview go bad? What was the interview like and who was it with? What questions did they ask. You talked about the income some but not all. Was the income a problem? It would help many others here in their visa if we had more info.

I had so many what I thought red flags myself that I was sure we would be denied from what I seen or heard from others here but got the blue then a pink. I put in what I had done all the way and even posted the questions asked and the time and who it was.

I promise to pray for you and also hope that in the future that this will make your love stronger and get this past you.

My wife and I are over it. We're moving on with our plans. I'll give it one last shot with an appointment request for the following week, in addition to popping in to use one of those two window-hours offered.

No, she answered all the questions right, just the basic stuff that we read on here. I've tried to look at our stuff from different perspectives, seeing what holes we had, and I can't tell you a specific reason other than not enough visits after the wedding and not enough letter for a long period of time.

I'm just looking forward to seeing my wife next week! :dance:
