My application is finally at the NVC and so I am, after a very long time, to the point of filling out my AOS paperwork :dance: I have a question, regarding what exactly I should send in to the NVC.

Here is the deal. I am a medical student, (my last year woooo hoooo) and since I am without a real income (I am supported my loans and grants) my parents have been kind enough to joint file the AOS with me. My question is whether I still need to personally file an AOS since my parents income is over 125% above the poverty line and my income is...negative. Should I just file theirs or should I feel out the paperwork for my own as well?

Another question, the i864 document states I need to include tax returns for the last year and can submit for the last 3 years. My parents are self employed business owners, so I will submit their 1040 forms correct? Should I submit for all 3 years or will one year be sufficient?

If you're the petitioner you need to submit an Affidavit of Support regardless of wether or not your income meets the requirements.

And submitting the tax returns for the last 3 years helps a lot (and it's not that hard to get them, anyway), but it's not obligatory.

That's as far as I know.

Well, I haven't filed because I have had 0 income for the last 3 years since i've been in medschool. I'm not sure how tax returns of 0 would have any effect.

You must fill out the I-864 for yourself regardless of your income. Also include an explanation of why your income is 0. Although only one year of returns is required 3 years may help. Good luck.

No, dude, really. Regardless of your income, you have to send the Affidavit. Attach a letter explaining why you haven't filed return taxes, etc. With proof, if you can get some (be creative).

My wife is on SSI (Social Supplementary Income) and she isn't required to pay any taxes, so she's getting a letter from the Social Security to back everything up. But yeah, she still has to submit an I-864 like everybody else.

Yes - and when the people who responded above mentioned the 3 years of returns - they were talking about your cosponsor - not you - it is clear you have no income.

A simple note stating why you have no income will suffice as an explanation to accompany your own I-864.
