Letter for Interview

To Whom It May Concern:

I am writing this letter to clarify the intentions of my fiancé, Josue *last name*, and myself with the K-1 Visa. In question 18 of the initial I-129F application, I stated the following:

“After marriage, our long-term goal is to settle in Guatemala, but due to my job and some other circumstances, we would like to get married and live in Virginia for up to two years after he arrives.”

When we initially filed the I-129F petition, we were under the impression that my fiancé would be granted a visa with a specified time period only for us to marry, and would then have to return to Guatemala. We were hoping he would be able to stay for approximately two years. After doing much more research, we now understand that upon entry with a K-1 visa, we have 90 days to marry and then will apply for his permanent residency. We fully intend on doing just that.

As his interview at the US Embassy in Guatemala is on April 13, 2009, we are hoping that he will be able to return with me on April 19, 2009, and we have already made an appointment with the Judge Mosby at the Circuit Court in *City*, Virginia, to be married on Monday, April 20, 2009, at 4:00 pm. We will then apply for his adjustment of status, and will follow the requirements for the process of obtaining and keeping permanent residency.

Looks good to me; just let your fiance carry it with him to the interview. Mentioning your wedding date may be more than the consulate wants to know, as it is a hint that you need him to get his visa right away. I hope he will, but the consulate must have the right to its administrative processing procedures, if it sees fit.

I have already asked the court if we could cancel that on last minute with no penalty and they said that's fine. I was going to put "tentative" but I didn't want it to sound like we weren't planning on getting married. Do you think I should just say "We are planning to do the civil ceremony the week after his entry to the US" or something general? I mean, we do have a date set, but it will only be him, me, my mom, and the interpreter, so we can change that if AP comes into play. Thanks for your response.

DON'T put the date of your court hearing on that letter!

Trust me when I say that the interviewer will feel like your overriding his/her "Authority" and they may put you in AP just for that.

It's crazy but I have seen some folks who THRIVE on that power.

Agreed. Just say the plans have already been made for a small civil wedding and will take place a week after his arrival.

I rewrote the final paragraph to look like this:

We have already made plans for a small civil wedding that will take place a week after his arrival. We will then apply for his adjustment of status, and will follow the requirements for the process of obtaining and keeping permanent residency.

Again, this is just in case they read the entire Question 18 response and question it. I will be attending the interview with him.
