Hello,

I wanted to know what you have to do after the fiance arrives into US on K1 and gets married.

Does the person have to apply for I-485. If they do what other information needs to be sent with it.

Also my last question is on the I-485 can the person put down thier new name or does the person have to file something after the marriage that they are chosing to use their husband's last name.

If anyone can help or point me in the right directions that would be great. Thank you.

Yes - you will have to AOS now.

Follow the guides above for information and the forms you will need.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

If you are changing the last name then make sure that the new name is mentioned on the marriage licence and subsequent marriage certificate - this is your proof of name change. Then you file your AOS with the new name.
