Was going through I-864 to understand documents required from the sponsor.

I-864: http://www.uscis.gov/files/form/I-864.pdf

On page 7, item 23 it mentions that submitting following items is OPTIONAL:

(1) pay stub(s) from the most recent six months (2) letter from your employer

However on page 11 (the checklist) the language is a bit confusing and it seems like sponsor MUST provide above two documents

Which one is correct? Is it optional or mandatory?

In addition W2 and 1099 to be submitted could be for just latest ONE year or past THREE years?

Thanks very much!

On the checklist did you see "You may submit this information...... if you believe any of these items will help you qualify? Difference between "may" and "must."

Thanks payxibka,

Source of the confusion was the heading "The following items must be submitted with Form I-864:". Headline mentions "must" while the paragraph underneath it mentions "may".

So I am assuming must + may = optional in this case?

Hi,

I too am looking at the I-864 instructions in preparation. It is confusing whether the actual tax returns and W-2s need to be sent or will they accept the Transcripts from the IRS????

On page 11 ofthe instructions, it states that "A copy of your individual Federal income tax return, including W-2s for the most recent tax yea, or a statement and/or evidence describing why you were not required to file"

However on the actual USCIS website instructions it states:

All sponsors must submit the following documentation with their I-864:

Proof of current employment or self employment

A photocopy or an Internal Revenue Service-issued transcript of a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax return for your most recent tax year, or an explanation if it is not submitted. Your W-2s and/or 1099 forms may also be required, see the I-864 instructions for details.

You may also, at your option, submit a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax returns for your second and third most recent tax years if you believe these additional tax returns may help you establish the ability to maintain your household income at the governing threshold set forth in Form I-864P, Poverty Guidelines.

Can anyone clarify please?

The website says to refer to form, so I would trust instructions on I-864. If you're sending transcript then you don't need to send W2 and 1099, but if you're sending photocopy then you do.

Hope this helps.
