hello everyone...i am a newbi. i hope to find answers or somehow be enlightened as regarding to my case. My american fiance filed a K1 visa for me ( I am from the PHilippines but presently in China, for 3 years now) last February of 2008. On March he received the NOA1. after that he did not receive anything else and case always showed up as case pending and received. On October 29, 2009, he received a letter telling him the delay of the application was due to background check. Our case has been left pending and received for a year already. My question is, 1. who is being check? is it him as the applicant or me as the petitioner? or both? 2. is there anyone experiencing the same? yes? how long did it take and do u have any idea what's going on and if we still have something to wait on? 3. my contract in my work will be expiring after a couple of months, will it be another factor of the delay if i go back in the Philippines? is it better to be in my country and just wait there?

i am so desperate to hear from you base on your experiences..i am just new here and i am not very sure whether topics like this were already brought up. PLEASE HELP ME WITH SOME INFO'S.

July 2007 - we met online

Dec 2007 - decided to meet

Jan 31-Feb14 2007 - we first met (China)

Feb 2, 2008 - we officially became steady

Feb 10, 2008 - engagement day

Feb 28, 2008 - he sent K1 petition for me

March 3, 2008- he received NOA1

April 25- May 4, 2008 - we met 2nd time ( China )

April to October 2008 - case pending and received

October 2008 - received letter about security check

Oct-Nov 2008 -we met 3rd time (China)

December 2008 - case still pending

Jan - Feb, 2009 - we met 4th time ( China)

Feb 2, 2009 - our 1st year anniversary

Mar 2009 - our case has been pending for 1 year :crying:

My mom had a similar situation happened to her when she petitioned her husband from China. She petitioned I130 instead of the I-129F. Basically the case was pending based on security check for a very long time they will eventually get to it, but i would suggest have your finance contact a local government official to check on the status of your case. It worked for my mom, she had to contact our city Mayor then she contacted a state representative assmebly member. It really work, usually you will at least get a response and know what's going on.

8/21/2009-- NOA 1 for I-485 and I-765 Hard Copy

08/29/2009-- Received Biometrics Appointment Letter in the mail, dated 08/26

My question is, 1. who is being check? is it him as the applicant or me as the petitioner[/u]?or both? 2. is there anyone experiencing the same? yes? how long did it take and do u have any idea what's going on and if we still have something to wait on? 3. my contract in my work will be expiring after a couple of months, will it be another factor of the delay if i go back in the Philippines? is it better to be in my country and just wait there?

your case might be hangin out in Admin Processing....if you have a common last name. Unfortunately, those with common names always get false hits against the security databases (like 5 databases). If you are JOhn Smith, you are screwed, because you will get a false hit, and then your case if pulled out, and hangs out with Admin people for eternity do manual checks, and clear your name from the false hits......might be time now to contact senator or rep to interven on your behalf, since its taking more than a year.

Hi everyone! Im thinking of a way to extend our K1 application to one year....HOw is this possible...? we have our NOA1 January 23..and still waiting for NOA2..what do you think should we do..? My Fiance is in US while am here in the Phillippines, but might need to go back to work in Middle East and Europe (can be moving around europe..) what can we do to extend to 1 year...? thank you!

forgive me if i did this thing wrong.. this is actualy my first time to post...

in the i-129f application ask "Has your fiancé(e) met and seen you within the two-year period immediately receding the filing of this petition?". is the 2yrs required?.. i havent file this application just yet b'coz i'm not sure if i should or not. i'm in between w/ I-129f or I-130 coz my fiance's work contract finish on Oct 2009 and not sure if he be able to extend his contract in Saudi. we r meeting on Dec 2009... thats y i'm not sure if i should apply or not. I wish sometimes theres ez way.. hehehe... :unsure:

mini choco, you really need to start your own thread about your issue. I only came back here to read this thread to see if there was an update from the original poster. You have to have met your fiance within the past 2 years, before filing the petition. If you're not meeting your fiance for the first time until December 2009, then you can't put in your petition until after that.
