We filed my husband's AOS in Feb 2008 and just got an interview date for 14 mos later. The medical exams are valid for one year, does this mean my husband has to take the medical exams again (this will be his 3rd time)?

7/19/06 - Married in Medellin

9/4/06 - Submitted I-130

9/18/06 - NOA1 Recieved

9/25/06 - Submitted I-129F

9/27/06 - NOA1 Recieved

11/22/06 - NOA2 Recieved for BOTH I-129F & I-130(APPROVED!!!)

1/22/07 - 1st Interview in Bogota (221g Issued, new appointment scheduled)

02/16/07 - 2nd Interview (Visa Denied)

2/21/07 - Contacted Senator Saxby Chambliss GA for Assitance

7/23/07 - 3rd Interview - Visa Approved!!!!!!!

11/13/07 - POE - JFK

AOS...A new journey begins

2/7/08 - AOS Officially In Mail _ Overnight Mail to Chicgo

2/8/08 - Recieved in Chicago

2/14/08 - NOA1 Recieved

We filed my husband's AOS in Feb 2008 and just got an interview date for 14 mos later. The medical exams are valid for one year, does this mean my husband has to take the medical exams again (this will be his 3rd time)?

Somewhere along the documentation there is a clause that says:

If you were admitted to the United States as a fiance(e) (K-1), child of a fiance(e) (K-2), Spouse of a U.S. citizen (K-3), or child of K-3 (K-4), and received a medical examination prior to admission, then you do not require another medical examination as long as your application for adjustment of status (Form I-485) is filed within one year of your overseas medical examination. You will, however, be required to submit a vaccination supplement with our adjustment of status application. The vaccination supplement must be completed by a designated civil surgeon."

I have searched this topic in the past as we had the same question, and it seems that as long as you file your aos before your medical exam is expired, you should be ok; however, i have read a couple of threads from people that got told they needed to do a medical exam at the interview, so is all in the hands of the clerk that interviews you. We have learned that there are rules and regulations, but you're still 'at the discretion of the USCIS'---in other words, if the clerk is moody that day, good luck! :whistle: Seriously though, if you filed for AOS before that year was up, then you shouldn't have to repeat the exam. However, I wasn't sure what type of visa you came in, but you might want to do a search in the forums as I have seen this topic in the past....

You are required to have a valid medical at the time you file for AOS. You did. So you should be ok. There is a chance that the interviewer may ask you to redo it. So you can risk it and hope they don't or be proactive and do it now and hand it in at the start of the interview.

Personally, I probably would not do it unless requested, but I may think differently if I had waited over a year. You have waited so long that if I were in your shoes I may not want to chance another delay and maybe it's worth the money spent.

My husband did his medical in Colombia back in January 2007, prior to his first interview. His K3 visa was finally approved in July 2007 and he entered the US in Nov 2007. We filed his AOS in Feb 2008, 1 month beyond the 12 month requirement and at the time, my husband submitted a NEW medical exam (Feb 2008) in addition to his vaccinations. That was at the time of our AOS application...now, 15 mos later we have the interview....being that he's young and healthy, we might just take the chance and go to the interview without a new one. I will look through some more post as several have suggested.

Simple answer is NO !....Here is the rule:

After the date of your medical (I-693) done in USA, you have to apply for AOS within one year.

It does not matter when you get the interview or GC. Once you have applied for AOS within 12 months after the exam,

your medical is good forever !.....

I want to clarify something here. The medical done back in the foreign country should not be confused.

For any type of K Visa, look at following :

As a K-x Visa Holder, you are supposed to do that in Part b which is in red.

From Uscis Site :

"What if I am a K nonimmigrant visa holder & already had a medical exam overseas?"

A. K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e), or as a

B. K-3 spouse of a U.S. citizen or a K-4 child of a K-3

spouse of a U.S. citizen, and

C. You received a medical examination prior to

admission, then-

a. You are not required to have another medical

examination as long as your Form I-485,

Application to Register Permanent Residence or

Adjust Status, is filed within one year of your

overseas medical examination.

b. You will, however, be required to Part 1,

Information about you, and submit the vaccination

section of Part 2 with your adjustment of status

application. A designated civil surgeon must

complete the vaccination section and Part 5, the

Civil Surgeon's Certification.
