Hi there, my fiance and I are new to this board. We recently filed for the K-1 Visa, and he forgot to include all of the photos of us together with the rest of the packet.

Naturally, I am freaking out just a little about it.

Does anyone know if this is going to really mess up the whole process for us, or should everything else we submitted be sufficient?

Also, does anyone know if there's any way we can send the photos as an addition?

I-485 and I-130 Timeline:

• First met online in 2001; become close friends and stayed in contact

• USC went to London in May 2008, on vacation; fell in love and began relationship

• Visited each other several times in Buffalo and London

• Engaged in spring 2009; filed for K1 Visa and this was approved

• Summer 2009 Beneficiary was accepted to 3 year Master’s degree program in the US; unable to complete K1 process at this time

• Beneficiary moved to US as student on F1 Visa in August 2009

• Lived together from September 2009 onwards, in US

• Married on April 10th 2010

• Sent I-485 and I-130 Applications to USCIS by certified mail on July 26th 2010

• 8/1/10 - Recieived return receipt showing USCIS received applicatons July 28th 2010

• 8/4/10 – Received email and text message update from USCIS – also were advised that we would receive NOA (Form I-797) via mail within 7-10 business days.

• 8/6/10 – Received Forms I-797 for all three applications in the mail.

Okay well did you include any boarding passes or passport stamps showing you visited each other/met in person? That may hold them off but I'm not sure, just going off everything I've read over the past month here!

In all honesty, I think the worst that could happen is they send a request for evidence in which you could then send them the photos. From what I've read that doesn't even actually add any time to the wait. But don't just send them the photos right now because they wouldn't know what to do with them. Wait for the RFE or, hopefully, just the approval :)

Photos are NOT primary evidence and in themselves are meaningless. If your primary evidence submitted is sufficient, this would be travel documents for one, maybe it will be ok. Likely ok? No. Likely you will get an RFE requesting additional evidence. Anything sent at this point will be sucked into the USCIS balck hole and never come out. Wait until you have an RFE (if any) and then send them in.

How long will it delay your case? Hard to say. When (if) the RFE comes, that would have been your approval. Any time after that until the approval is received, is the amount of delay.

Yep... I don't think a lack of photographs should be an issue. I have read sooo many case decisions from the USCIS AAO and not one mentioned needing any or more photographs for an appeal to be sustained. If you do receive an RFE, it will be because you haven't submitted enough primary evidence. If you have submitted enough primary evidence, then you shouldn't have to rely on secondary in order to prove your case.
