how does the special pardon for an existing deportation order work?

i have/had a deportation order on me from an asylum case my parents filed which got denied, according to my lawyer he says i have to ask for that special pardon when i have my interview.

how does it work.... to anyone who has filed this in VJ?

You are filing for a K3, so I assume you are in your home country now? Did you enter legally or illegally into the USA, and if legally, how long did you overstay? Did you leave when the deportation order was filed or did the government have to remove you? How old were you when this happened?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I am in my country, i came here on my own... we got that deportation order when i was 14 i overstayed 1 yr cause according to the law it only counts after i turn 18...

How long have you been outside the country?

From your description, it sounds like you need both the I-601 Hardship Waiver and the I-212. The 601 is for the overstay and the 212 is for the deportation. The best place for information on these two waivers is www.i2us.net There are tons of people filing the waivers and tons of information on how to prepare your waiver package.

If you have an overstay of 180-364 days it is a 3 year ban; overstay of 365 or more is a 10 year ban (from the time you exited the U.S.) For the 601 you have to prove that it would cause your spouse extreme hardship for you not to be allowed to enter and live in the U.S. The 212 is a discretionary waiver and really is approved any time the 601 is approved. For it you prove relationship and good character, among a few other things.
