I'm wondering if anyone can help or has been in this situation. I get so many different answers from the people at USCIS. We had our AOS Interview for the K1 visa on DEC. 8, 08. At the time the Interview was completed, the Interviewer didn't tell us if we were approved or denied, but I figured we would get something in the mail a week or two after the Interview. We haven't received anything at all in the mail, and when I call USCIS I get the same remark that we have to wait 3 months after the interview to enquire about the case. Well, what I'm confused about is we paid $1,010 for the AOS package. His EAD card will expire next month and I don't know what we have to do to extend his EAD until he gets an answer on his AOS. Do we have to pay another fee to extend his EAD? And if so, where do we apply for an extension? If anyone has any info about that I would appreciate it!

Have you looked at the instructions for the I-765 for a renewal?

I would make an infopass appointment at your local office to inquire about your case, There is no extra fee for filing for a renewal EAD and you can e-file so it should be faster as you wont need to wait for the mail to deliver it to the service center.

Hello;

First of all, you should hear something about your interview, either positive or negative.

It has been almost 3 months. If I were you First, I would call the NCSC at 1-800-375-5283 & ask about the result of

my AOS interview. If you would not get any answer, you can get InfoPass appointment

to ask to extent your spouse's EAD. Good Luck...

yeah...i'm getting quite concerned about our aos interview...especially since i see most people on this site either get an answer right at the interview itself, or they get an approval letter in the mail within a week or 2. really confusing. i called uscis about a month ago and they said we're still within the normal time as far as waiting for an answer.

thanks for all the replies...was wondering too if anyone has experience with living in washington state and trying to make an infopass appt for the portland oregon office, since i live closer to portland than seattle?

Yes Jasman, I applied for the EAD at the same time as the AOS paperwork was sent in. As far as what I'm reading now on the instructions for I765, this means I don't pay another fee for a renewal? After i fill out the form online, how long does it generally take to get an approval?

I'm in a similar situation except my wife's temporary 90-day EAD card will expire a good two months before she gets her AOS EAD card. Also looking for an answer.

She stops work until she has a valid EAD.

The EAD in her passport has a little stamp that says "expires": Then there is a handwritten date. How in the world would anybody know about this handwritten expiration date? Unless her employer says something, she is going to continue to work. More importantly, we paid the $1,000 to adjust status which means the EAD card is (slowly) on the way.

There are two things that irk me about the whole immigration and EAD situation:

1) Why in the world is JFK the only gd airport in America that issues the EAD stamp? These future American citizens should be allowed to immediately work upon entry so that they can contribute to society and stimulate this economy by spending their hard-earned money. Every airport in America should issue the EAD stamp.

2) Why in the hell is the temporary EAD issued at point of entry only valid for 90 days? Does that make any sense? Assuming a couple on a K1 visa get married the same day they arrive into the United States and send in the AOS package; the adjustment of status EAD card would, at earliest, arrive in 90 days which means there would still be a gap. Most couples are going to wait a month, maybe even two before everything is situated and the AOS package is shipped out. So why not make the temporary EAD card valid for 6 months and make everybody happy (employee/employer/US economy/etc)?

I agree with you...my husband will also continue working. If we have to, we'll just show that we filed for an extension on the EAD. Makes no sense that we've had the interview 3 months ago and filed everything then, paid a hefty amount and this happens where we have to file for an extension.
