OK, so it gets frustrating and expensive to search for Pinay in Phils, and do all the waiting, only to find out she was playing games and not serious to me. So, maybe I will try to find Pinay here in US who was brought here, married to kano, and then separate/divorce after a short time.

So, the general question is, how complicated is it (immigration wise, to marry her and make her legal here) to marry a divorced Filipina who is in USA for lets say, 2 years or less, and does not have her immigration status settled here yet. Thanks for you input and experiences. I am a serious guy and only want to find a nice lady and marry her, in spite of the complications of an unsettled immigration status.

If you are older, fat and ugly your chances of latching onto a pretty pinay that already has her GC in the US are WAY lower [NO chance] than if you pursue one in the Philippines.

No problem in that dept. But thanks for your input. I am trying to find out from an immigration point of view, regarding how complicated is it for the pinay to be legal when she remarries in US.

All depends on what her immigration history is.

"Have faith in God, Jesus answered. I'll tell you the truth. if anyone says to this mountain, Go, throw yourself to the sea, and that does not doubt in his heart but believes that what he says will happen. it will be done for him. Therefore I'll tell you, whatever you ask for in prayer, believe that you have received it, and it will be yours" (MARK 11:22-24)

Well, I'm pleased you found my serious question so entertaining, but I am still hoping for a serious answer, preferably from someone who has had the experience: You meet a divorced lady, who came over on a K1 Visa, marries her petitioner, they divorce after 6-12 months because it isnt wedded bliss. This lady has an unsettled immigration status without AOS completed.

So where does this leave this type of lady when she marries another kano? I'm thinking someone in the community here has seen or had this happen. Thanks, gang!

If the person that she marries is a US citizen, then the USC spouse can file an immigration petition for her and adjust her status to get a green card. She would not need to go home.

If the person that she marries is a Legal Permanent Resident (green card holder), then she will have to go back to the Philippines and wait for until the LPR spouse becomes a US citizen or after a 5-6 years wait.

Any petition filed for her will be under higher scrutiny then usual. USCIS might suspect that she is scamming for a green card and neither marriage was legitimate.

If the lady came with a K-1 visa and didn't adjust status with her petitioner, there is no way for her to adjust within the US. She has incurred overstay and will have to go home, wait out the ban or file a waiver.

The requirement of a K-1 visa is that you MUST adjust status with the petitioner of your K-1 visa, there is no way around it.

AOS Approved on 10-17-08 (details in profile)

Removal of Conditions on 07-19-10

In this tedious process, we tend to forget that this is all worth it.

I love my hubby beyond anything in this world.
