I filed a I-129F petition and received an NOA1 and a Request for Evidence. However, I was out of town for a long period of time and our mail box filled up. This caused the post office to bounce the letter back. I eventually got the notice sent to me again.

Anyhow, I did eventually respond to the RFE with the requested information. But, I missed the original deadline for responding to the RFE. Is my I-129F / K1 pretty much dead? I have called the Vermont service center on numerous occassions. They insist that my case is still open. But my case status has not changed 3 months, AFTER respoding to the RFE. Should I just scrap the application and start over?

I don't know how much longer you've waited to respond, but I'd send in the information requested, maybe with a note saying why it was late, and see what happens. If you have to start all over again, you're going to have to refile the fee as well, so while it's up to you, I'd just see if they'll resume processing once you send the informaiton in, particularly if it's not too far past the 30 days.

If your petition were 'closed/rejected' you would have received a notice. Without a timeline (in your profile) it's difficult to predict if you are within normal processing times or to recommend a course of action. I wouldn't recommend 'scrapping' anything and starting over though. :thumbs:

What 30 days? My RFE allowed 87 days

No your application isn't dead, if they say it is active. The online service is often not updated. My wife is getting dressed to go out for the day. She has her green card. We will go to Montreal tomorrow, she is used to that now, traveling internationally since she got her green card. Our I-129f case is still listed as "received and pending".

Wait patiently, get your packet 3 documents ready now.
